The thing is. This sounds like a legitament defense. They could say that the adrenaline could alter his emotion, this along with him being in rage could causehim to not pay attention to his weapon that was suppose to subdue the suspect. Also you could look at the placement of the weapon, is the taser next to hisgun, was he in a brief scuffle with the suspect moving his belt over a little. (I didnt view the video) Was this at night. In my heart i believe its murderbased upon the responses. At the same time we must let our trusty court system do thier job. (This response was meant to be sarcastic, I am not responsiblefor any angry emotion involved with this response THANK YOU).

This is disgusting. Something really needs to be done about this $&!+. A 23 y/o just got shot in his chest and liver in front of his own house by the"Police" a few weeks ago out here. These people are the ones protecting us?
 
this is ridiculous and some of yall need to quit making excuses. not all cops are bad but how can you trust everyone when they are all in the same uniform withthe same power and you have no idea what their deal is.

what does it take for a cop not to get away with some nonsense like that. it's always an accident, it's always he took a deep breath we thought he wasreaching for something, he yawned he shouldn't have we thought he had a gun. it's like no matter what they can always get a freebie with murder andtonss of people in their corner. I mean we have a got damn video, and still nothing. what if there is no video, just our words versus theirs. Wth do we needlike an hour recording of a cop torturing someone before the murder while they hold their i.d. up and smile to get any kind of justice? makes me sick.

Oh, he got the chair alright. He got the chair and desk duty for this. Can you believe that? If it were a civilian he's be slapped withmultiple charges including murder of a cop, meanwhile this POS gets desk duty. No justice

Some police use-of-force experts who have looked at footage of the incident have said that Mehserle may have meant to fire a Taser at Grant but instead mistakenly shot him with a gun.

But Burris said, "I'm not sure if that's true" and pointed out that BART hasn't yet said one way or the other if Mehserle had a Taser during the incident.

Burris said he doesn't think Mehserle had any justification to use even a Taser on Grant.

He said that if Mehserle deliberately shot Grant with a gun, the officer should be prosecuted for second-degree murder.

Burris said if Mehserle had intended to use a Taser and mistakenly fired his gun, the officer should be prosecuted for involuntary manslaughter.

"It's negligence if you pick the wrong weapon," Burris said.

saw this on digg. the taser excuse is unjustified because the victim was already handcuffed on the ground. we're becoming a police state... there is noaccountability by these guys
 
I saw this on the news not too long ago. I wonder what bart station that happened in.

I thought it was going to be about something I saw in Oakland on the 31st. I was at the 19th or Lake Merrit bart station I forgot. BUt when I got to theentrance there were hella cops and fire trucks and the whole nine outside. As I was walking down the escalators I saw hella blood all over the steps. The copstold us to walk as close to the wall as we could.

Burris said Tuesday that the young men had been celebrating the new year at a popular waterfront tourist spot, The Embarcadero. They were heading home when police pulled them from the train car.

Some of the young men were handcuffed, but not 22-year-old Oscar Grant. The video from the anonymous passenger shows Grant seated on the floor with his back against the wall.

Grant holds up his hands, appearing to plead with police. Burris said Tuesday that Grant was asking police not to use a Taser.

"He said to them, 'Don't Tase me; I have a 4-year-old daughter,' " Burris said.

The interaction on the video is not audible.

Seconds later, police put Grant face-down on the ground. Grant appears to struggle.

One of the officers kneels on Grant as another officer stands up, tugs at his gun, unholsters it and fires a shot into Grant's back.

Burris said the bullet went through Grant's back and then ricocheted off the floor and through his lungs.

Grant, who has a 4-year-old daughter, died seven hours later, KTVU reported.

"I couldn't believe it. We was already following directions and everything, and they shot him," Fernando Anicete, one of the young men with Grant, told KTVU.

Burris has spoken to witnesses who claim that Grant was trying to resolve the situation.

"He had been telling people to calm down. 'Be cool. Just do what they tell you to do,' " the attorney said.

Yo that's was shady. How is an officer gona confuse his taser with a gun? Why would he pull out the gun if the situation was under control! No need forthat! Hope that officer dude get some serious prison time.
