My buddy dodged a DUI

My dude got pulled over yesterday,after he'd had a few. He refused all tests, and the cop told him he would cuff him and bring him to the station (notarrested) and when he got to the station he told them that he wasn't refusing the blood test, or DUI or anything, he just was refusing to submit to itwithout his attorney present. The police allowed him to call his lawyer and thereafter his attorney told the police he would come and be present for thetesting. The lawyer followed the instructions he was given and showed up 8 hours later. After 8 hours, the test was administered, but goddamn thats more thanenough for the alcohol to sink in. Needless to say the police were enraged but what could they do?

I'm not sure what the laws on FST and breathalyzers are..but hey...maybe it was a rookie cop mistake.
 
smart move by your buddy to get out of it

stupid move by drivin drunk in the first place tho
 
Loophole indeed. Seems like your friend knew what he was doing, but SMH at DUI. I have no sympathy for those who drink and drive.
 
damn homie got lucky. i thought if you refuse any test, whether field, breathalyzer, or blood, you immediately have your license suspended for 1 year? (whetheryou lose your DUI case is a different story, since they dont have test results as evidence against you)
 
hmm good way to get out of it if you already know you've got a couple drinks in you.

some dude was pulled over right infront of my room window 2 weeks ago

cop had his gun drawn and everything telling him to get on the ground

to make a long story short...DUI, cuffed, friend was released, car was towed
dude passed all the tests except breathalyzer
 
I have another story. This took place in the Tentleytown part of D.C. I was coming from an American University dorm and had had a good amount to drink. Theonly reason why the cop pulled up next to me (he didn't pull me over, he just pulled up so that our windows would match and then he talked) was that Imerged into his lane at a circle and at said circle you are not allowed to do so. He looked at me and said that I was either tired or had been drinking. I toldhim I was a bit tired, then he asked a couple more questions before coming back to asking me for the final time if I had been drinking. I admitted that I had acouple of drinks a few hours back. Since I was heading to Maryland, he told me to head straight there and get out of D.C. i.e. letting me go.

Wish that wasme. I'm doing community service for one as we speak, I wasn't driving though...but thats another story. I definitly don't condone drinking anddriving though.
 
i had a homeboy that almost caught a dui..we pre gamed before we went to the club..got to the club drank a lil more..when we left we were all still drunk..coppulls us over on the way back to the dorms..ask the drive if he had been drinking..drive lies and says no..cop said the car smelled like alcohol so he askedthe driver to step out and take a sobriety test..drive gets out..was gone for like 15 min..comes back and wasn't sure if he had passed..cop comesback...said he passed the sobriety test but still wrote him a ticket for speeding

There has to be more to the story than that. Cops dont justdraw their guns and tell the guy to get his face on the pavement for a DUI....especially if he wasable and willing to take tests (most of which he passed you say). He must have gotten violent or something.

so is this in every state where they must allow your attorney to be present before they adminster any tests?
i need to get myself a lawyer. for those that have 1, how much is it? do you pay monthly, yearly, etc?
 
This won't work in Florida. By having a driver's license you are already consenting to a breathalyzer exam. It's all on the back of your license.
