My dude got pulled over yesterday, after he'd had a few. He refused all tests, and the cop told him he would cuff him and bring him to the station (notarrested) and when he got to the station he told them that he wasn't refusing the blood test, or DUI or anything, he just was refusing to submit to itwithout his attorney present. The police allowed him to call his lawyer and thereafter his attorney told the police he would come and be present for thetesting. The lawyer followed the instructions he was given and showed up 8 hours later. After 8 hours, the test was administered, but goddamn thats more thanenough for the alcohol to sink in. Needless to say the police were enraged but what could they do?
I'm not sure what the laws on FST and breathalyzers are..but hey...maybe it was a rookie cop mistake.
