People don't understand that the 50-100-lifetime ban punishment is for positive tests only. MLB is attacking him under the "Morality Clause", which is just like Goodell having free reign to suspend/fine players for how he sees fit.
I'll ask this again. If teams aren't liable to pay contract/luxury tax, what is to stop other teams from trying to use the "Morality Clause" to get out of contracts? The Yankees are the most popular team in baseball. They drive ratings, which in turn creates revenue. Why wouldn't MLB try to free up money so the Yankees could then spend on other free agents to become a better team?
Collusion is defined as a "secret agreement or cooperation especially for an illegal or deceitful purpose". The Yankees are cooperating with the investigation to get out of paying a ridiculous guaranteed contract with luxury tax implications. The fact they aren’t fighting for their player is a joke.
You're talking about a separate instance.. When Cash told him to shut up... He went to a doctor that cleared him for REHAB games, team doctors were the only ones with the ability to clear him. Yet anyway he was playing in rehab games less than a week later.. Then he gets injured again, and brings the injury to the Yankees.. He sits to let the injury healed.. Again, he "goes" to a different doctor than one approved by the team. And the doctor didn't even see him, they talked over the phone. Despite that he was playing rehab games less than a week later.
You have to prove the idea of Morality Clause... And you'd have to prove that the behavior was so unbecoming that it should void more than a game or two, If anything at all.. Unless the guy is out raping woman, or dealing drugs.. You'd have a lot of trouble trying to get out of a contract. So it's not setting a precedent... Also, the morality clause isn't being used for PED use.. It's being used because he recruit other players to Biogenesis, then tried to destroy the evidence, and impede MLB's progress in the case. Had he shut up, and stayed out of the way.. He'd get only 50 games, and the morality clause and lifetime ban would never be discussed.
Yankees have paid the highest salary every year except for 1 in the past 11 years. They never have problems spending money or luxury tax.. Even scrapped the idea of even trying to get under the luxury tax for a single year.. Even without ARod's contract, they would not be able too.. 2009 Yankees already had ARod's contract, and still spent it on C.C., Burnett, Teixera.. The idea that suddenly Yankees will go on a spending spree with money saved on ARod's contract that they wouldn't before is overblown... Because they'll be at about $200mil even without ARod.
They are cooperating because MLB is their boss.. Not they other way around.. They have to cooperate.. Even with cooperating, they have almost nothing of use for MLB in investigation.. Fight for their player? What the hell do you want them to do?Edited by Essential1 - 8/1/13 at 12:48pm
