Sperm DONOR is ordered to pay child support. Vol. Really?

I was gonna say this is a great example for why gay marriage should be legalized on every level but then I read this:
Adding to the case’s complications is the fact the state, in court documents, is alleging that the contract Marotta entered into with the women — under which he wasn’t liable for financial responsibility for the child — is null and void because the insemination wasn’t performed by a licensed physician
The state has a case with this right here. I mean it's clear what they're doing but the 2 adults ****** up on this part. If not for that this could gain a bit of a movement for how unconstitutional this is.

 @ you dudes not reading the article and just posing from ignorance.
I was a sperm donor for my sister and her wife. Worked out good!
Please tell me they mixed your sperm with the wife's egg and didn't pull one of those mix bag we don't need to know who is technically what inseminations :x

Ill be honest and say I did not read the article. I just want to know what made the state go out of their way to take this guy to court on someone's behalf that didn't ask for it. Hes not committing a crime against the state of Kansas, so its odd.

what a surprise its kansas....basically i think this is a scare tactic to keep others from helping out gay couples...whether its donating your eggs or your sperm the state will come after you.

lol @ all these comments saying the couple is wrong etc...did you numbnuts read the article? they had nothing to do with it..the state went after the guy on behalf of the women..
how so....theyre gay/***** not idiots...they new the laws, and also how the state viewed certain issues, due to the fact they went before them to consummate the marriage, plus they have adopted kids so the whole process etc... as far as having kids etc...was explained to them.

So they werent ignorant to the facts, They might have thought oh well we will never have to go to the state, so it wasnt an issue to them. But they def. knew that this situation could have occurred. Not only that, if you arent married to said father etc..they go over everything at the hospital at the time of birth. Also if they didnt want to involve him, on the dfacs form they ask you about the father or you can omit and basically say you dont know.

Many girls do this when they have multiple baby daddies in which they will get cash from them and get full benefits from the govt. or they do it if the amount of child support would be less then the benefits they recieve from the govt.

i think they answered the question honestly not knowing that the state was going to hunt the guy down and make him pay...

i had to edit my last comment since it made no sense whatsoever

As a father of two they go over and explain it to you....they go over it at the time of birth certificate,,,and they also give you info etc... to dfacs such as resources etc...where to/how to apply for govt. benefits child support etc... And even then before you are granted any benefits. they do a in office interview before the paperwork is processed. So between the hospital, the birth certificate, the request for said benefits, the in person meet, and the interview...um yea im sure they after being shown and explained something like 5 times they just "didnt get it"...

Its not just some oh i want food stamps child support etc,,, and they say oh ok sure. Its a process, you get a caseworker who explains everything to you, the clerks etc...who go over all the paperwork and forms before you turn it in, and the interviewer who goed over every question and section of the forms beat by beat. Just letting you know just incase you ever get caught up in a situation like this.

see thats what alot of dudes dont get, there is no law that allows you to be a father,,,that is unless married. Yes you have the RIGHT to be a father..(in terms of visitation, making decisions etc...) But that is all..and if you dont know by now. rights cost money. Alot of ppl confuse rights with laws, and they are not one in the same.

Think of it this way you have the RIGHT to bear arms...meaning you must go by a set of guidelines, rules etc...to be allowed to do so...and must be granted permission by a person appointed by law to allocated you to exercise said rights. Which anyway you slice it, if you want rights you better pony up some money.

If there was a law allowing a male to be a father (outside of being married, family court, mediators, family counselors, dfacs, etc...would basically be out of business. Family attorneys would be broke, and a good amount of ppl in the jail system would be out of a job as well.

I don't get how this is legal, when legally he is not the father. Biological yes, but not legally.

well because he didnt do a legally recognized sperm donor. And also they do a presumption of paternity. The guy if the mother so chooses to place him on child support, it is up to you to provide/request paternity. If not your child then case is dropped. If so then child support is retro active and starts at the time of request or at birth.(judges discretion). Which he will fail...and lord forbids he signed the birth certificate... then presumption of paternity wouldnt matter...cause whoever signs that birth certificate is the legal father, from a fiduciary standpoint aka pay child support.

I mean they could essentially end all this by denying govt assistance. Because what alot of ppl dont know is that even if a mother decides not to place you on child support, if she recieves any govt... asst. programs that directly or indirectly benefit the child, they will make you pay into the system as a form of child support. But lets be foreal they aint giving up no foodstamps tanf and wic... medicaid..etc.

View media item 195203So you're both the biological parent and uncle?
Son that's certified weird.
This is probably exactly how the family from Texas Chainsaw Massacre started.
...

No. He's the bilogical parent but "legal" uncle. And legal is in quotes depending on what state he lives in and if his sister's marriage is recogonized.

He's the "legal" uncle as well as the biological uncle. The child is his sisters child, afterall.

Once I read craigslist this dude lost all respect from me. But then again he did try to help a partnership grow strong through the way of a new born life. This is another reason why we can't have nice things.

Damn the law for doing ol'dude wrong like that. I would want to help but not in the way that they take most of my money because 2 lezzies couldn't get it done. :smh:

ah man ****** situation for dude.  he's gonna end up paying.  kansas doesn't support gay marriage, chicks knew that.  social worker probably grilled them without them knowing it like, 'oh what a nice table lamp.  where'd you get the kid?,' and they just answered without thinking.  social worker thinking, 'GOT 'EM!,'.  why the **** didn't they go to a licensed physician?!  people man, people.
