Colorado movie shooter's not guilty by insanity plea: ACCEPTED Vol. What!?

Let me ask you all a question, had he been mentally ******ed would it make a difference? You still think he should be denied constitutional rights?

You think if he was mentally ******ed he would've been able to do what he did? or even think about doing it? SRS...

Not surprised. This is America, where highly educated brilliant lawyers are trained to outwit common sense.

They're just going to put him back on the streets so he can kill again.

Mentally disabled is the accepted term. And just be a use someone is mentally disabled doesn't mean they can't shoot a gun in a crowd full of people. I've worked with me tally disabled adults and even though some may lack the ability to function as a majority of society does on their own some are very intuitive. I know a few who if u tell them what ur bday is in less than 5 seconds can tell u what day u were born on or able to do math calculations with ease or be able to paint beautiful portraits. Also mentally retarted is a derogatory term same as calling me a n***** because I'm black
 
If hes insane and kills people that should be more of a reason for the dp lol.

FOH with the hypothetical talk. We live in a world based off facts buddy, fact is, he ain't ******ed. And he had already exercised his constitutional rights when he was allowed to ask for an insanity plea, the court didn't/shouldn't have to accept it though but they did anyways. :smh:

I hope you understand they're able to do all these things because somewhere else in their brain is functioning at an extremely ****** capacity.

Don't think a "mentally challenged" person is capable of orchestrating a massacre. Walk in the theater and just start shooting? Yes, but planned massacre, no.

Bruh c'mon now don't make it seem like he orchestrated the greatest mass killing in history. He went and shot a group of people in a theater a PACKED theater of course there's gonna be mass casualties any idiot can do that don't make it seem like u have to be the next Einstien in order to pull that off. Anybody with a gun and ammo can kill a group of people in a confined space. But we getting off topic dude should never get out and be sent to prison
 
A judge accepted James Holmes' long-awaited plea of not guilty by reason of insanity Tuesday and ordered him to undergo a mental evaluation — an examination that could be a decisive factor in whether the Colorado theater shooting suspect is convicted and sentenced to die.

The judge also granted prosecutors access to a hotly contested notebook that Holmes sent to a psychiatrist shortly before the July 20 rampage, which left 12 people dead and 70 injured in a bloody, bullet-riddled movie theater in suburban Denver.

Taken together, the three developments marked a major step forward in the 10-month-old case, which at times has inched along through thickets of legal arguments or veered off on tangents.

Holmes faces more than 160 counts of murder and attempted murder, and prosecutors are seeking the death penalty.

He will now be examined by the Colorado Mental Health Institute in Pueblo, but it's not certain when the evaluation will begin or how long it will take. Hospital officials have said that before they meet with Holmes, they want to review evidence in the case, which prosecutors said totals nearly 40,000 pages.




King, the defense attorney, told Samour on May 13, without specifying a diagnosis, that “qualified professionals” concluded Holmes wasn’t sane at the time of the shooting.

Senior Deputy District Attorney Jacob Edson told the judge at that hearing that he wanted to know exactly when, after Holmes’s March 12 arraignment, the defense learned new information about the defendant’s sanity. Edson argued that in order to change the plea, Holmes’s lawyers had to show what happened between his arraignment and the May 13 hearing.

Public defenders representing Holmes objected on due process grounds to a provision of Colorado law blocking Holmes from calling witnesses at any sentencing hearing to present evidence about his mental condition unless he cooperates with court-appointed psychiatrists.
Truth Serum

Under state law, psychiatrists can require Holmes to submit to interviews under the influence of a drug popularly known as truth serum, according to Karen Steinhauser, a former Denver prosecutor now in private practice.

The judge who previously handled the case, William Sylvester, ruled that prosecutors may require Holmes to submit to a “narcoanalytic interview” under the influence of “medically appropriate” drugs. Such drugs can enable people to recall something they’re having difficulty remembering.


I have no problem with this ruling. I believe whether he is insane should be investigated. I'll be following the developments.

I'm not a conspiracy theorist but when you see what his Dad was involved in and who he worked for, as well as testimonies from James Holmes' classmates who say he wasn't a 'loner' and could never see him doing something like this, it just makes me think.

And then compare that to his whole demeanor in court, he is FOR SURE on some kind of medication, he just looks like he's in another world.

These individuals should be trained, time to start operation human shield... right... Jails are overcrowded and just cost taxpayers tons of money.
Agreed. What is the trail really for? To give him a chance to explain himself? To get him to justify it? To glorify him more so that others see the amount of attention he gets? It's known that he killed those people with multiple videos to prove it. Give a redneck 5 bucks to take him out back,shoot him, and use him to feed the pigs. Money and time saved.

it's because it was a setup. they don't want to punish him for doing something he didn't actually do, so they'll let him off. The message was still sent and the effect they were going for, they got.

Not him per say but there will be tons of copy cat killers who will use this legal tactic! Then the Feds will pass a law that will give them the power to kill American Citizens without due process... oh wait....
