I keep thinking IM is the villain

He is. There are other villains but he's the biggest one

Seeing as he isn't taking any evil actions against Captain America or the people of the world at large, no he isn't. He's literally following the law in fact.

Yeah, but correct me if i'm wrong the reason Bucky's being hunted down is because of his suspected involvement in causing an international incident. Doesn't sound evil to me.

That assumes that Steve was speaking of Iron Man's team specifically as not planning on taking Bucky in alive.

And Cap was working with SHIELD in Winter Soldier, which was a front for HYDRA Cap himself still had completely different beliefs and was fighting for something completely different. Along with not knowing who Cap is talking about, you don't even know how many people he's talking about. It could be a few people out of the entire American government or even the governments of multiple nations. That doesn't then place them all on the same level as the group that wants Bucky dead, for whatever reason. And because we don't know who Cap is speaking of, we have no idea of whether Stark is working with them or not.
