Jonathan Fleming spent nearly a quarter century behind bars for a homicide he didn't commit. Brooklyn prosecutors recently found in the original case file evidence that proved he was in Florida when the crime took place.

A man who spent nearly 25 years in prison for a Brooklyn murder that took place while he was vacationing in Disney World was set free Tuesday in a highly emotional hearing.

“The day is finally here. I’ve dreamt about it many nights,” Jonathan Fleming said as he walked out of court. “I'm finally a free man.

“I feel wonderful," Fleming said. “I’m going to have dinner with my mother and my family and I’m going to live the rest of my life.”

Evidence that was not disclosed to the defense during his trial — which would have confirmed his alibi for the August 1989 slaying in a Williamsburg project — was unearthed during a review of the case by the Brooklyn district attorney’s office.

That included a phone receipt from an Orlando hotel showing he was there just hours before the murder and a report from local police, which interviewed hotel staff who remembered him.

Both documents were found in the case file.

“It could not have possibly been a mistake,” one of Fleming's lawyers, Taylor Koss, said of those non-disclosures by the authorities before and during his client's trial.

The DA’s re-investigation also discovered police reports that confirmed a recanting witness account that cops dropped felony charges against her after she falsely identified Fleming.

A source said prosecutors are aware of a person who’s believed to be the actual killer and may now go after him.

Relatives of Fleming, including his mom and two of his four kids, filled the courtroom and erupted in applause and cries of “Thank you, God” when Justice Matthew D'Emic, Administrative Judge for Brooklyn Supreme Court, officially released him.

“I've waited for this so any years,” mother Patricia Fleming, 72, said through tears after she hugged her son.

I feel like a burden was lifted.”

The woman, who testified at trial about their vacation, was still frustrated.

“An innocent man did all this time,” she said. “I was with him and that’s what hurts so bad.”

Because documentary evidence was withheld, the prosecutor back then was able to convince a jury that Fleming — who had videos and photos from the Disney vacation— could have hopped on one of 53 flights, shoot dead Darryl Rush, 22, take a flight back and then return to Brooklyn again the next day.

“Today’s actions follow a careful and thorough review of this case, and based on key alibi facts that place Fleming in Florida at the time of the murder, I have decided to dismiss all charges against him in the interest of justice,” Brooklyn District Attorney Ken Thompson said in a statement.

Jonathan Fleming’s conviction was overturned Tuesday at a hearing in Brooklyn Supreme Court.

Thompson has inherited a trove of questionable convictions that a revamped Conviction Review Unit is still poring over.

On Tuesday, their work received praise from all sides.

“This is a glorious day,” said Fleming's ex-wife, Valerie Brown, 46, who also testified during the 1990 trial about the Florida trip.

“Somebody heard our cries and today is a new beginning,” she said. “It’s going to be a process but we're a strong family.”
 
How do you overlook such a fact like that?

I'm turning 25  this summer. I can't fathom having spent all those years behind the wall. NYPD is grimey. Greatest city deeze nuts.
 
if ya thought NYPD is corrupted now, the stories and personal accounts from very close relatives of actions taken by NYPD back in the 80's would blow ya minds, these dudes were literally an organized gang to its full extent, an old classmate who was a retired paramedic told us he would assist NYPD during raids back in the 80's, they would only report maybe 25% of the cash and drugs found, split the cash amongst the medics and officers at the scene and the officers will take the drugs and put them back into circulation....some wild ****

a relative of mines was facing 20 years after she was framed with i believe 3kilos of cocaine, dudes literally planted this **** underneath her table at a restaurant and then raided her with swat team and all, made up this huge case, they didnt know she had the balls to take them to the supreme court without taking a plead, she fought the case with a public defender and won, the NYPDs lies crumbled in court and all their documentation didnt add up, she wanted to set up a civil suit, but was adviced against it, because of how evil these dudes were, her attorney told her if she was to go after the NYPD she wouldnt live passed a month.....bros, i knid ya not, these dudes were ruthless much more than what we see today, werd to those kids that were convicted for those central park crimes and spent 10+ years in prison for nothing.
 
I read about this yesterday.. was scratching my head trying to figure out how they convicted this man even though he had all kinds of proof showing he wasn't even in the state at the time of the murder

The prosecution should be put in jail for not giving the defense all the evidence they had.. but instead they'll get a slap in the wrist and told not to do that again.
 
Good ol justice system. You become speechless after something like this because you know theirs hundreds maybe thousands of cases like this.

@ksteezy  After watching American Gangster a few days ago, I researched some of that stuff. Right after everyone was getting on Richie for doing what he did with the money.. Grimey stuff with the PD

It wasn't overlooked. A POS DA, eager to have another conviction under his or her belt, purposely withheld this information during discovery.

This happens far too often with minorities. Especially black males.

That's a cop out brah, and you're better than that. There's a difference between randomly winning the lottery and having evidence, that clearly vindicates you of any wrong doing, purposely withheld.

It is unfortunate that this happened, nothing he receives from the state (if he gets anything) will make up for all the time he lost.
