Courts Cancel Washington's Name Patent VOL: "Disparaging"

The U.S. Patent Office has ruled, and cancelled Washington ******** patents because the name is “disparaging to Native Americans,” as first reported by Think Progress. The challenge had been brought by lead plaintiff Amanda Blackhorse against Pro Football, Inc., originally filed in 2006. (the decision can be found here.)

As explained below, we decide, based on the evidence properly before us, that these registrations must be cancelled because they were disparaging to Native Americans at the respective times they were registered, in violation of Section 2(a) of the Trademark Act of 1946, 15 U.S.C. § 1052(a).

What does this mean? Certainly there will be appeals before such a decision is finalized, but it is a first step toward a potentially troubling situation for Daniel Snyder. As the opinion notes, they can only rule on the statutory right to register, and not the right to use. Washington can still use their logo and name. What they won’t have, if the decision is upheld, is the ability to prohibit others from also using it, to have protection against others who would try to sell merchandise.

That kind of economic pressure may the only thing that might impact Snyder. Without intellectual property protection for the Washington name, logos, caps, t-shirt designs, etc., the merchandise will have less value. As we’ve seen in other cases involving the NFL (see the lockout litigation between the NFLPA and NFL), especially in a politically charged area, the initial ruling does not always hold up. The stakes have been raised, though.
 
Now the question is, how fast will the NFL force Dan Snyder and co. to change their name. Will they? and what will it be?
 
The cancellation of the ********' trademarks will not have an immediate impact. They will appeal, and be allowed to continue exclusively using the trademark in the meantime. But should the cancellation stand up, there will be nothing on the federal level to stop random schmoes from selling ******** gear

i'm surprised by this decision. it's the right one. didn't think a patent office would be so progressive or intelligent enough to make a decision like this one

I'm really shocked to see the U.S. Patent Office cancel the ********' trademark. I knew this way picking up a lot of steam by that media, but this is a disparaging blow for the ********. All that money they're about to lose out on.

Forgive my ignorance, but can someone please tell me why Dan Snyder doesn't want to change the name of the team? Is it a history thing?

Snyder gotta be the stupidest Sports owner ever, and yes that includes Sterling. This fool is fighting to NOT make even more money. As soon as the name change happens the whole fan base is gonna have to buy new gear

Look at Stanford, I never knew they had another name before the Cardinals. Probably could've kept the Logo if they had changed the name to the "Washington Reds" years ago
 
i can see the argument about why the team name should be changed, I get it and all but can you really force someone who owns a team he paid hundreds of millions of dollars for to change the name?

I totally get how Native Americans would take offense and have every right to be offended by the name but if the team name changes, then what happens next.

This may seem like a reach to some, but if people who lost family members, lost their houses, and/or were displaced from Hurricane Katrina, Hurricane Andrew, or any other tragic Hurricane were to take offense to their being a NHL team named the Carolina Hurricanes or a College Team named the Miami Hurricanes, would they be taken seriously.    I can't relate to anyone who may or would be upset by that because I never lost my house or a relative or friend to a hurricane, but while it may sound silly, I can see where and how a person who lost their home in Katrina or a similar hurricane could take offense to that team name.

Point i'm trying to make is if people are offended by Washington's football team name,  there may be other team names that people might take offense to.   The reasons may seem silly to most or some but to those offended by them it might be a real reason.  

Again this can sound silly, but maybe decendants of those who lost family in the Revolutionary War might take offense to their being sports teams called the Kings because their decendants from years ago lost their lives fighting a war because we didn't want a Monarchy in America.     Again this is an extreme example but if one team name gets forced to be changed for whatever reason, what's going to happen next?
 
^Sorry but that's so ******* stupid. I'm all for hearing the plight of people who are offended by the Wichitaw White Trash or the the Dakota Darkies.... or the logo of the Cleveland Indians, but your typing nonsense.

So your saying that it would be silly for someone who lost their home and family in Katrina only to be relocated to Houston and did dirty by the government to take offense to a NHL team called the hurricanes or a college team called the hurricanes, especially when that state, Florida has been hit hard with hurricanes over the years?

Also how can you force someone who spent hundreds of millions of dollars on a team to change the name? You got a right to not like the name and he got a right to tell you to kick rocks.
 
My dude you're saying silly things, stop. We'll just write it off as you're bored and keep it moving. And yes I've lost family and friends to hurricanes and all manner of other things. Maybe I should sue killa Cam.
