Car Accident vol idk what to think

Morning NT.

    So last night my sister got into a car accident.  She was driving in Baltimore two cars ahead of her some one was parallel parking so she came to a stop because the car in front of her came to a stop.  The car in front of her was the one that stopped for the parallel park-er.

This dude comes up the street and just hits my sister who then hits the guy in front of her.  Dude was easily going 40mph and didn't even try to stop.  So he gets out of the car all hyphy about "why are you even stopped".  Hands in the air.  My sister calls me and i showed up about 3 mins after it went down.  The guy that hit her is bombed out of his mind.  Not making any sense at all.  Is telling me he got his phone stolen and something about the lights are bright.  I was like whatever man.  

Cop shows up....dude has Fire Department plates on his car.  Which it turns out is his mother-in-laws car not even his.  We tell the officer that the guy is wasted and needs to be arrested.  She says that she can't arrest him without a sobriety test.  We said ok then sobriety test him.  She says she isn't equipped to do that.  And I said i would like to formally request you breathalyze him.  "We can't breathalyze him unless he is under arrest".

So dudes wife shows up and is trying to get him away from the cops because he clearly isn't coherent.  The cop then comes back up to me and says "well he said he had a few drinks and takes medication".  AGAIN im like

The tow truck shows up takes my sisters car away and the other car away.  We are told to go home.  Nothing is done about the drunk driver.  I think it might have had something to do with the Fire Department plates.  The whole situation seemed so sketchy as im getting more and more angry at the scene that nothing is being done about the fact that the dude that could have killed my sister is WASTED.  Not even just drunk, dude was gone.    

So we are filing a complaint with the Baltimore Police today.  Have called the insurance company to get that process started.  But if the dude lies and says he wasn't at fault some how then that starts an investigation and that takes a lot of time and my sister doesn't have a car....all of this could be avoided if he was arrested at the scene for DWI.   Is there anything else i can do?  Its too late now to get him arrested which really pisses me off.

If she has full coverage, the car will be fixed or she'll get a check regardless of fault.

If she was stopped and he ran into her then it's his fault, case closed.

I can stop stop on the middle of the highway for no reason at all and if i get hit, guess what, not my fault.

Only thing she needs to be concerned with is if he has insurance.

Matter of fact, you don't even need to call your insurance if its his fault, you call his.
 
Man OP, I'd be pissed. You should have requested to see their supervisor.
Sadly when i said i want to formally request a breathalyzer she called her supervisor who gave her the BS excuse of the dude needs to be arrested for that to occur.  There were two cops on the scene the woman was the first one and then a dude showed up later and both were really young.  The female cop was asking me about what happens to her car note if she ever totaled her car....i was like you serious right now?

The whole scene was a complete joke.  I felt like i was in the twighlight zone with how everyone was so nonchalant about what happened 
 
Contact the local news media. Immediately. You will get nowhere going through the Police Department, and especially not the Fire Department. All police officers responding to a car accident are equipped to breathalyze. In fact, its standard procedure when someone is even suspected of drinking. In situations like this, you need to demand to speak to a supervising officer, take down badge numbers, and refuse to leave the scene until you sre satisfied. If the supervising officer isn't giving you the answer you want, ask to speak to the shift commander. If all else fails, call the state trooper.

Tell the news that the police officer refused to breathalyze an obvious drunk driver that was at fault for the accident. You have pictures which is great, but try to get the specific officer's badge number. Send all the evidence you have. The quicker the better.

You learn that terrible people do terrible things.  This dude will lie, or dodge insurance calls or do something to make it seem like he wasn't at complete fault.  Sadly i have had this happen to me.  I was without a car for 2 months while the process got figured out, had to pay a lawyer had to go to court had to waste so much of my life because of it.

I envy you OP. I would have blown up to the point where I probably would have got arrested.

I should have video taped the whole thing.

The dudes wife shows up...tells him to get in her car and basically takes over.  She knew he was bombed and kept saying "stay in the car and shut up...dont say anything and stop talking"  I was like is this real life. 

This dude that lived near by heard the accident and came out and was like "this dude is getting locked up tonight he is so trashed".  I have never seen some one so blatantly gone.  At one point he lit his cig and leaned against the front of the cop car to smoke it.....

I have the badge number of the cop that was there.  A complaint has been filed with internal affairs and my sister is writing to the baltimore sun crime reports.  

Appreciate the advice though guys reppin everyone

There was a police report made.

Technically you are correct.  But people who get wasted and crash into you normally tend to be not the most upstanding citizens.  So i am worried about what he tells the insurance company because i was hit at a dead stopped red light and the dude that hit me lied to his insurance company and told them I swerved into his lane and he didn't react in time.  But yes he does have insurance.  

It is just angering when you think about "justice"  like this dude gets to get wasted, could have seriously injured some one, and gets to go home wake up, say wow what a crazy night.  Insurance fixes his cars, his premium goes up, and he gets to live like nothing really happened
 
Keep fighting it man. I know it can be a long and stressful process but can't let this dude get away with this. Like you said he could have killed someone, and the cops defiantly handled it that way dude to his connections with the fire department. Idk about where you guys live but the cops in my area are always hanging at the fire station with the fire fighters.

I don't think anyone is disputing whether the car will get fixed. It's whether the guy will lie to insurance denying fault causing a length investigation and more or less the ******** behavior of the police. If it does go to an investigation who knows what will happen since the guy who crashed into OP's car has police friends.

Just out of curiosity is the police report accurate OP? Also if you have full coverage you should get a rental while the car is in the shop.

wow. hope that piece of gatbage gets his comeuppance. best of luck. next time, pull out your phone and syart recording the interaction. i also hope you wrote down names of officers, and any witnesses who could back you up.

What if dudes fights the insurance saying OPs sisters stopped suddenly? Or brakes lights weren't working? Ect.

That looks serious as well. The entire front of the car is smash and most likely had frame damage.

Depending on the year, car prob a total loss.

I didn't even think of this.  

The settlement would probably be wayyyy more if he was arrested for DWI or DUI.

I haven't seen the police report yet this happened last night around 10pm so we are still gathering the info.

She only has liability but she will get a rental pay for it then hopefully get reimbursed for it once the insurance takes blame and pays her

If I stop suddenly and you hit me, its your fault.

If I don't have brake lights and you hit me, its your fault.

Proper distance while trailing and control over your vehicle trumps ALL.

Once again, the only thing intoxication plays a role in is him going to jail or not.

It plays no role in who is at fault with insurance companies in this case.

@ how the police handled that. His plates definitely made a difference. Had they done what they were supposed to then the process would be so much smoother.

Glad that your sis is OK.

Yeah but all it takes is for him to have a different account of the events....and then it becomes a ridiculous process....
