The settlement is based of the insurance estimate on cost of repairs, medical bills, pain and suffering claim in which his insurance company will negotiate with you or your lawyer.

His intoxication would only hurt him, it wont help you.

I don't get this?  Him being drunk def would give a lawyer leverage in a court case to get more out of the insurance company would it not?

I'm not 100% sure, but my take is why would it.

But his drunkness doesn't raise the price of parts and labor.

Nor would your doctor add extra charges to your medical bill because of it.

I see what you are saying I got $1k paid for "damages" on top of all of my repairs/doctor/medicine/rental bills.  I would think that is where that would come into play.

Anyone that has ever been rear ended badly can vouch it stays with you.  Every time you stop and look in your rear view you are nervous...if a car approaches you fast from behind you get scared.  It really sucks
 
You obviously have no idea what your talking about.

Some states when you hit from behind the driver who hit you is automatically at fault.

Some states you aren't.

And ethnically the driver that hit OP's sister should be in jail. He could've seriously injured her or someone else driving in his condition.

And the only reason he isn't in jail is because of the plates on that car and the way the police handled it.

While OP is upset about the accident he's also upset about the way things were handled.

Your right, state laws do vary, but him being in jail vs being free doesn't have much to do with the insurance process.

Op sounds like you have everything on your sisters side regardless.

May take some time, but your sister will get hers.
 
You should have recorded the whole incident, then you would have had solid evidence. I guess you're gonna have to wait and see what happens

We are calling a lawyer today to figure out if it is worth it.

I know when i got hit since i wasn't hurt the lawyer basically told me he can't make money off me if i am not hurt.  He was like go to one of my doctors....i was like uhhh im fine...he was like ok but get checked out by my doctor....i was like ummm no thanks im fine.  So i just got the settlement from the insurance and didn't hire a lawyer
 
If she wasn't prepared then she or I would've contacted an officer that was prepared. U would've called 911 again, quickly. He's going to be at fault, most likely.

Messed up that he didn't get arrested.

The lawyer friend we have said that Bmore cops are known for doing this.  I don't get it

This is crazy, him getting arrested would automatically place him at 100% fault and thats why it is so important. It kills me how some people think... :smh:
 
Bmore cops county and city do that type of crap. I've seen it numerous times. I have a buddy whose sister is friends with the guys on the drunk driving task force and they all drive around smashed regularly. Gotta love the system.
 
My sister is a cop and she told me ALL officers should be able to conduct a basic field sobriety test. That officer was lying to you.

OP - do you have a badge # or anything documenting the officer that you dealt with? This is BEYOND shady. Yall may have laughed at dude who brought up going to the media, but I think your side of the story SHOULD be heard because what happened to your sister is awful.
 
Also the fact that the dude admitted to having a few drinks is what REALLY makes this fishy. But let me play devil's advocate, say that officer wasn't equipped for a field sobriety test, she is supposed to call either a DUI specialist or someone who knows how to administer one. But lets go even further and say nobody wasn't available (very unlikely) the fact that he admitted to having a few drinks is enough for her to arrest him on SUSPICION of a DUI, then they do a blood test and a breathalyer until he is cleared.

Something isn't adding up here breh.

Next time tell the cops you want to make a Citizens Arrest.

Anyone of us can make an arrest if you feel for others and your safety.



As far as the accident goes,

Lawyer up, if your sister was injured, tell her to take as much time off needed and go to the Doctor/Chiropractor as much as possible.

The higher the bills, the bigger the check she'll get back. She probably didnt feel pain last night, but Im sure she felt it today in the AM.

Muscle stiffness and soreness is probably the side affect of the accident.

Make sure she writes down everything that happened, from the accident to the aftermath where the driver was making no sense to where the officer would not arrest him.
 
I only read the original post. But this was probably a time when a cell phone camera video with the cop saying what she could and could not do probably would have got her behind doing what was fair to all parties.

Thank God the guy didn't kill anyone
 
We wrote a letter to the Baltimore sun.  He said he is interested in more details.

She took off work today too she is sore she said so we will have to go to the doctors.
