Jordan 16 XVI Legit Check

Need a legit check on these 16's, I'm thinking they're fakes smh. Got them off eBay from a seller with 100% positive feedbacks, now I'm second guessing.. anyways, hope the community can help. Main concerns are the gators (no velcro), the mesh upper doesn't have texture when i run my fingers on it and the sizing. I'm a size 9.5, got these in a size 10 but they fit like a size 9 so can't even wear them. What do you guys think? If fake then I'm contacting seller asap/opening a eBay case.

100% fake from what i can see. the date on the tag suggest it was released in 2004. but the original release was february 2011
