Someone sped by her in a wide one lane street, she swerved out the way, lost control, went into a tree...she walked away with bruises and a swollen foot, THANK GOD....part of the chassis ended up inside the car :lol:

You're S.O.L OP. If you don't pay those storage fees they probably own your car now. Read what you signed and see if that's the case. They got you in a rush of emotion and won. They knew what they were doing too. :smh:

You might have to take the L on this one and start saving for a new ride. Next time let the insurance company handle it before you deal with a body shop. But really with liability and no comprehensive or collision, you were doomed from the start unless it was someone else's fault completely. That's why you're not getting but half of what your car is worth. Seems like in this case the other company is only covering that dude's fault up to half. You're lucky to get that honestly.

The value of your vehicle has no bearing on the cost of fixing body damage. That doesn't even make sense. You definitely have frame damage, that can be seen in your pictures. To the people asking why his insurance company didn't total the car, he only has liability coverage. They definitely won't be taking that L for you. You signed paperwork so unfortunately you don't have many options. Take this as a lesson learned. Try to work out a deal with the half of the repairs you will be paying out of pocket.
 
I have literally never heard of "right to dismantle". And it especially doens't make sense in this situation.

I understand you being on the hook for the storage fees, but that should be it. Pay the storage fee and get your car back.

Id say pay the fine to get your whip out of there. Leave it at the crib.
Have the other insurance give you the funds for the repairs to pay the storage fees.

I wouldn't trust them with fixing my whip. Plus whips that have been damaged are more susceptible to future problems.

Save & buy a new whip.


I know that pain fam. I have only liability too & thats a reality we face. No whip.

I know I signed my life away. I didn't expect for it to be this expensive to fix. I also can't try to get it out of the shop and go elsewhere cuz I signed something that sends the check to the body shop (smh I kno). Is it even possible to fight his estimate? What if I were to get the parts myself?
 
Car repair is EXPENSIVE. A car be a total loss just for hail damage you can't see unless you're right next to the car.


I doubt you know where to buy or what parts you need regardless it's not gonna change the price much labor costs the most


I'm guessing you don't have the cash but if you do pay the storage fee etc. couple weeks = 1500? or so.




Being uniformed/cheap is what got you here stop waiting for a solution to fall out of the sky and go do something. What have been doing since last month :smh: You're digging yourself a deeper hole.
 
they basically took your car as collateral for fixing it. this is predatory as hell and few states have laws that protect people from getting into ur situation
 
Small update

since the side curtain airbag went off it is really expensive but since it is not required by law I told him not to fix it. Now he told me I wont be able to pass inspection or blah blah but thats just him trying to save face right? If my car is supposed to have side air bags and i elect not to install them does it matter?
 
Do you have collision coverage on your personal auto policy?

And who decided fault was 50/50?

That's how they got my cousin. Never trust a person who arrives to the scene acting like their a godsend, when in actuality theyre bloodsuckers.

Honestly I would just take the car, or visit another autobody shop and have one of their guys follow me their posing as a friend and get his word for it.

Do you and the shop have a agreement in writing?

Yes he signed paperwork based on what we read.

Your car is going to have a rebuilt/salvage title. They do an inspection at the dmv to sign off on your car being safe to drive if im not mistaken. I dont know if they will check that. But they might.
 
Honestly OP, you brought this on yourself. Not only that but you're STILL trying to cut corners. Not installing airbags that have deployed. What part of the game is that? Sell the car and get a bus pass.

That's not true. Police, Insurance companies and courts can decide who's at fault.


Police report + citations = fault. They don't have the final say though.

The police report aids in the investigation, is not the end it all of it though, in some cases/states/counties a police report is not even filed unless there were injuries....ultimately is up to the insurances to decide and fight for WHOS at fault or not.
