Got a cellphone ticket.. while using bt earpiece. I need help.

Yeah the judge can ask the officer if you actually had your phone up to your ear, the officer won't lie. He only seen you place it down. Then you could explain what you actually doing.
 
Should have argued it.

I got pulled over before for not having a front license plate. I told the officer I never received it and he told me the DMV always gives you two. I kept my ground and said I never received it, so there's nothing I can do. I got a warning and he told me to contact the DMV and put it on. Case closed. I still don't have a front plate cause it was in my trunk.
 
What state are you in and how much is the ticket? I would definitely request for a hearing from a judge. Is there a clear cut law that says you can't have your phone in your hand?

In California. Happened in LA during rush hour bumper to bumper traffic.
That's what I've been looking for. A law that says you cannot have a cellphone or electronics in hand while operating a vehicle. All that i could find is using a Bluetooth which is acceptable while operating a vehicle.

And thanks for your input nt. Seriously, I knew I could count of you guys for advice.

Yeah I put it down because when we made eye contact .. he signaled which i took as put the phone down and pull to the right because he was not behind me to flash me down.
 
Everyone in California holds the phone up like its no thang. They should just get rid of the law, I think people cause more accidents trying to be discrete and texting.

You dun goofed. You shoudve told him that and argued right there. Youre basically screwed right now, its his word vs yours. You have no proof of a bt set and he had his statement on the ticket. Why you aint argue?

I’ve personally seen a woman beat this same exact case in court. She pled not guilty the first time around and when her second court date came she chose to represent herself. Her argument was that she had to psychically place her bluetooth device next to her phone for the two to pair. Cop only saw her reaching near the phone and wrongfully wrote her a ticket.

From my perspective I think the judge favored her because she came correct. She was respectful, well dressed and spoke direct. She brought in the bluetooth device and was going to show the judge how it fails to pair at a distance and why it needs to psychically touch her phone. You can tell the judge figured nobody who isn’t innocent is going to take the time to miss two work days just to beat this nonsense case, so he cut her off and said she was innocent. Also, most cops never show up for a second court date when you choose to fight the original one. You have a chance fam.
 
I think I told this story before but anyways I was in NYC and just got a tattoo done and forgot I left my wallet at home (had my friend spot me for the ink :lol:).

So I was going home and during certain times you cant make right or lefts on certains streets, I forgot and I made a right turn onto 5th ave from 33rd or something and an officer flagged me down (he was on foot) and asked me for my license. I went looking for it in my pockets (forgot I left it at home) and then I realize oh officer I left it at home, I just got a tattoo blah blah but I have a pic of t on my phone. I coudnt find my phone after scrambling for a minute and just remembered it was in my trunk. I told the officer my phone is in the trunk, can I get it? He asked do you have anything else on you? I said yeah... uh my friend has cigarettes and he said no, I mean a credit card, insurance card anythig in your name, and I said oh I thought you meant drugs or anything of that sort ( :lol: ) yeah but I think its in the trunk. He said youre a mess, I dont wanna deal with you and let me go. :lol:

Judge fell for the old psychic bluetooth defense.
 
Idk how it works in California but in the states I've been in if you get a ticket of any kind and you go see a hearing officer they will usually athe least reduce the amount if you have a good story. It's not like some trial where you have to produce evidence and have a solid defense. It's not even that serious. I've been completely in the wrong and admitted it and they still knocked off half just to get me to pay it that day.

If youre right hand...with the phone in it....was on the shift....how did he see the phone

Or

If you were holding the phone up and he saw it.....why were you holding the phone up if you have a bt.....in 4mph traffic?
 
Off topic but reminded me of when I see dudes with earbuds in while driving. Irks me smh.

Got a ticket by a walking cop while I was stopped at a light with the phone on my lap, not in use...fought and lost in court, needless to say....take that L

There is literally no justice in traffic court...only time you have a slightly better chance is by hiring a lawyer, in which case you have to pay him instead of paying the fine...either way you lose...lol
