So you can only defend yourself against someone with a gun as it happens in that moment? I mean, technically this all played out in one scenario. Yeah, the driver could've let the police handle it but what person wouldn't be amped out of their mind after just getting robbed at gunpoint? I hope there is a statute that will protect the driver in court.

That is correct. This isn't the wild west. Driver is also liable for the medical bills. Civil suit would be open and shut.
