Tailgater gets brake checked and crashes (Lulz?)

I have always wondered about this becuz i see this all the time.

whos fault is it?
What would YOU do on either end?

I always keep a distance enough to avoid this
 
Both are stupid, but the tailgater is the instigator and I hold him accountable for the crash, keep your distance.
 
:lol: in dying that the person who braked check just kept it moving while the tailgater got the worst of everything

Happened to me once .. I won since dude was stupid and took off ..I was backed inTo but he could've said I rear ended him

Never try to pass/speed when you encounter merging traffic on that right lane. I thought that was common sense. I've seen semi trucks cut off the fast lane traffic in these situations. Tailgater is lucky for that barrier in the middle. Really could've killed someone.

thats a bad day but it's his fault....you can still keep a safe distance and let the car in front of you know that you would like to pass them.

Just wondering how you do this? 9 times outta 10 when I'm behind somebody going slow in the fast lane they just stay there no matter if I'm 1 car length or 5 away

Also, some states are "no fault" states I think so if you rear end somebody nobody is at fault. Not sure which states though. Somebody correct me if I'm wrong

tailgators own fault. but that slow af lead car brave as hell for mashing the breaks. Dude coulda smashed him and did some real damage.
 
I'm not going to stop tailgating but I drive a performance car with traction control that can stop on a dime. Also my reaction time is good enough to match speed regardless. and lastly there's plenty of space.. go around the other driver. this guy was amateur deserved it.

I see ******** tailgate all the time but the brake checker is at fault. It makes no sense to even do it. What if he doesn't swerve? What if he ends up not even stopping and hits you? You really gonna risk getting yourself killed because some idiot wants to tailgate. Move to the right lane and let him go ahead of you then move back to the left lane. Driving really brings out the worst in people.

Dude should not have been that close. If there was debris in the road same thing could have happened.
