State District Judge Mike Erwin has been banned from Sammy's Grill, a popular local eatery and watering hole, after sheriff's deputies responded to an incident there Friday night during which a patron claimed he used a racial slur toward her.

Erwin, a Baton Rouge judge, was involved in an argument that prompted a disturbance call Friday night at the Highland Road restaurant to which deputies — including one already at the restaurant while working extra duty — responded, said Casey Rayborn Hicks, the sheriff's spokeswoman.

Hicks said one patron alleged Erwin directed a racial slur toward her during a disagreement.

The woman, Kaneitra Johnson, wrote in a widely shared Facebook post the next day that the judge at least twice called her "n****r" during an argument over a seat at the bar.

The Advocate spoke with Johnson, who confirmed she wrote the post.

Erwin didn't make himself available to a reporter for The Advocate on Tuesday or Wednesday, instead issuing a "no comment" through two different staff members. 

Sheriff's deputies spoke with others at the restaurant who said they didn't hear the conversation and couldn't confirm that Erwin used the slur, Hicks said.

"There was a disagreement between patrons, but no arrests or criminal charges or anything," Hicks said.

A manager at Sammy's Grill, Andy McKay, said "we do not want Judge Erwin's business anymore," adding that staff had been notified by the restaurant's owner, Sammy Nagem, that "we are going to be refusing his business." McKay said he couldn't speak to what prompted the ban, and messages left for Nagem weren't immediately returned on Wednesday.

A sheriff's office report on the incident hadn't been filed as of noon on Wednesday. Hicks said deputies typically have up to seven business days to complete a report.

Court records indicate Erwin was assigned a 2010 traffic case against Johnson. In her Facebook post, she said she didn't recognize him at the restaurant or realize he was a judge until after speaking with deputies following the incident.

Erwin, 67, is the 19th Judicial District's most senior judge, elected to the bench in 1990. He was re-elected to a fifth six-year term in 2014.

As a minority you simply can't trust southern whites, especially those in law enforcement and the judiciary.

It's frightening. Imagine the wrongs he's done in that position of power.

Him and thousands like him.

Our judiciary is systematically built on racist, biased, often hateful white men, determining the fate and freedom of minorities.

All while the vast majority of American Society i.e. white society either, support it, are indifferent, or at best are naively complicit.

While at the bar, Johnson says they struck up a conversation with a Lyft driver who was seated at the bar.
“He was sitting and I was standing that entire time. He stepped away to the restroom so I sat in the seat until he got back, ” said Johnson. “When he got back I asked if he wanted to have his seat back and he said ‘No. I’m about to go any way.’ But before I leave I do need my jacket. “
Johnson says she and the driver share the seat until he leaves. “I’m halfway on the seat and the Lyft driver is on the other half of the seat. Then he asked for his jacket. All of a sudden I hear this older man behind me tell the Lyft driver, ‘You never give up your seat for a n_.'”
Johnson later learned that the man hurling the racial slur was Judge Mike Erwin.
As Johnson and the driver sat side by side, the older man continues, “You should have made her get her fat n_ a_ up.”
The driver says, “Well, this is my seat while I’m sitting in the seat. When I’m not in the seat it should be anyone’s seat.”

Hope he gets disbarred.

my question is, in about 20 years, when all these old racist people die, how different will it be?

or is the racism so institutionalized, that there are already 20 year olds with this mindset ready to be a part of the new order?

all i can do is live my life, but it kills me a little inside everytime i witness or hear about overt racism

Racism is like family heirlooms, gets passed down to the next generation.

Taught to younger generations by parents/grandparents. The cycle continues.
 
Down south need a good cleansing. Racism is everywhere but if we can get rid of a good 60% of those people there the world would be a better place. And the country side of NY too, drove through there this summer and it's a different world once you leave the city :x
 
Throwing one judge out changes nothing. We're talking about a city where a man was murdered on video for standing in front of a liquor store and the white population kept it moving like "so?"

He'll be replaced by a racist and the "justice" system down there will continue their bs. The man running the country is the same type except he has a different accent.
 
I swear the entire judicial system needs to be purged. Go thru everyone's record and anyone with incidents of racism in the past gets cut. Our institutions are flooded with these people and I've been seeing too many stories recently like this one.
