Sanders defends Omar: Can't equate anti-Semitism with 'legitimate criticism' of Israel


Sen. Bernie Sanders (I-Vt.) defended Rep. Ilhan Omar (D-Minn.) on Wednesday amid an avalanche of criticism she’s received over comments about Israel that some have slammed as anti-Semitic.

Sanders, who is running for president in 2020 and in 2016 became the first Jewish politician to win a state's presidential primary, said he fears a House resolution intended to rebuke Omar over the comments could end up stifling legitimate debate over the Israeli government’s policies.

“Anti-Semitism is a hateful and dangerous ideology which must be vigorously opposed in the United States and around the world. We must not, however, equate anti-Semitism with legitimate criticism of the right-wing, Netanyahu government in Israel. Rather, we must develop an even-handed Middle East policy which brings Israelis and Palestinians together for a lasting peace,” he said in a statement to The Hill.

This judge's ruling that Wilbur Ross broke several laws and violated the constitution is not the end of Ross' legal woes however. Ross is also having trouble getting his financial disclosure cleared because he has repeatedly filed false information in those disclosures, wittingly or unwittingly, and that includes his most recent disclosure. In a very unusual move, the Office of Government Ethics refused to certify Ross' financial disclosure report, citing both inaccuracies and Ross not being in compliance with the ethics agreement at the time of the disclosure report.

This excerpt now also marks 2 judges concluding that Ross acted in bad faith during his sworn testimony to Congress when he misrepresented his reasons for adding the citizenship question.

Wilbur Ross broke law, violated Constitution in census decision, judge rules
Commerce Secretary Wilbur Ross acted in “bad faith,” broke several laws and violated the constitutional underpinning of representative democracy when he added a citizenship question to the 2020 Census, a federal judge ruled Wednesday.

In finding a breach of the Constitution’s enumeration clause, which requires a census every 10 years to determine each state’s representation in Congress, the 126-page ruling by U.S. District Judge Richard Seeborg in San Francisco went further than a similar decision on Jan. 15 by Judge Jesse Furman in New York.

The Supreme Court has already agreed to review Furman’s narrower decision, with arguments set for April 23, but may now need to expand its inquiry to constitutional dimensions.
The Commerce Department did not respond to requests for comment.

The administration has been on the losing end of scores of court decisions involving immigration issues since President Trump took office. But the census case has taken on special significance because it strikes at the heart of the United States’ form of government and because of what Seeborg described as a “strong showing of bad faith” by a Cabinet secretary who, influenced in part by White House advisers, tried to conceal his motives.

The cases against Ross have been brought by jurisdictions with significant immigrant populations. Only two have completed trials, the case heard by Furman and brought by 18 states led by New York, and Wednesday’s challenge, initiated by the state of California and combined with a suit brought by the city of San Jose.

Unable to find any expert in the Census Bureau who approved of his plan to add the citizenship question, Seeborg wrote, Ross engaged in a “cynical search to find some reason, any reason” to justify the decision.

He was fully aware that the question would produce a census undercount, particularly among Latinos, the judge said.

That would have probably reduced the representation in Congress — and thus in the electoral college that decides the presidency — of states with significant immigrant populations, notably California.

Because census data is used to apportion distribution of federal funds, an undercount would also have cheated these same jurisdictions, the judge said.

Seeborg, like Furman, found after a trial that Ross misrepresented both to the public and Congress his reasons for adding the citizenship question last March. Ross claimed he was acting at the request of the Justice Department in the interest of enforcing the Voting Rights Act.

In reality, the “evidence establishes” that the voting rights explanation was just “a pretext” and that Ross “acted in bad faith” when he claimed otherwise.

He pursued the citizenship question after hearing from then-White House adviser Stephen K. Bannon and Kris Kobach, the vice chair of Trump’s now-disbanded voting fraud commission.

Apart from violating the Constitution, Seeborg ruled, the Commerce Department breached the Administrative Procedure Act by acting “arbitrarily and capriciously” and violated Census Act restrictions on modifying questions.

Ross’ financial disclosure rejected by government ethics watchdog
The head of the Office of Government Ethics has refused to approve Commerce Secretary Wilbur Ross’s 2018 financial disclosure report, citing an inaccuracy concerning the former investing mogul's holdings of BankUnited stock.

The action is the latest blow for Ross, who has repeatedly drawn scrutiny over his personal finances since he was nominated for the Commerce job. He is scheduled to testify next month before a House committee.

“OGE is declining to certify Secretary Ross’s 2018 financial disclosure report because that report was not accurate and he was not in compliance with his ethics agreement at the time of the report,” Emory Rounds, the OGE director, said in a Feb. 15 letter.

In an Oct. 31, 2018, report, Ross said he had “a mistaken belief” that an order to sell BankUnited holdings had been executed in 2017. That error was featured in a Campaign Legal Center complaint sent earlier this month to the Commerce Department’s inspector general that said if the false filing was knowingly made then that would be a violation of law.
In a statement on Tuesday, Ross said he held 100 BankUnited shares totaling about $3,700, “an amount that federal regulations deem de minimis and below the threshold of a possible conflict of interest.”

“While I am disappointed that my report was not certified, I remain committed to complying with my ethics agreement and adhering to the guidance of Commerce ethics officials,” Ross said.

The Campaign Legal Center on Tuesday applauded OGE’s action.

“It confirmed what we have been saying for a while now and it shows that OGE is also concerned about Secretary Ross’s commitment to upholding the public’s trust in government,” said Delaney Marsco, a legal counsel at CLC.

Last year, congressional Democrats asked the Securities and Exchange Commission to investigate potential insider trading by the Cabinet secretary. He is set to appear before the House Oversight Committee on March 14.
 

Let it sink in that Kushner was rejected for a security clearance but was then given one because the WH overruled the rejection on Trump's orders.
