A seventh-grade boy was allegedly raped by another male student during gym class at Barack Obama Global Preparation Academy in Los Angeles two weeks ago.

The 13-year-old boy, identified only as Julian, is a special-needs student at the middle school, reports KTLA. He has the mental capacity of a six-to-eight year old.

The boy’s parents, who are also only identified by their first names, announced plans to to sue the Los Angeles Unified School District on Monday.

At a press conference, Brian Claypool, an attorney retained by the family, said that Julian’s physical education teacher left Julian unsupervised during class. The alleged assailant, an unidentified eighth-grade boy, then lured Julian behind a set of bleachers and sexually assaulted him.

Julian’s mother said she filed a complaint some two months ago because she feared that other students were bullying Julian during gym class. She says school officials did nothing in response.

Both parents now argue that school officials should face criminal charges for criminal child endangerment charges, according to KTLA.

Claypool characterized the alleged incident as part of a broad failure on the part of the embattled school district to train staff and safeguard students. He argued that someone should have been monitoring the unknown assailant.

“How was he wandering throughout the school, running around, recruiting another boy to have sex with him behind a bleacher?” Claypool demanded indignantly in front of a bevy of reporters. “Does anybody at LAUSD care where the kids are during a class?”

Julian’s parents also spoke at the press conference.

“Somebody, that particular day, dropped the ball,” said the 13-year-old boy’s mother Toyian.

“You can tell he’s ashamed,” she also said. “I mean, if I was raped or assaulted, I would be ashamed.”

“I am not happy,” Julian’s outraged father Mark added. “This should never take place — not just to my son, any kid.”

The school district has released a statement concerning the alleged incident: “Allegations of student-on-student misconduct are taken seriously. Upon learning of the allegations, the school site acted to appropriately document and notify authorities of the suspected abuse. Although we cannot comment on the specific allegations or any potential lawsuit in this case, we are committed to ensuring student safety at all times.”

The Los Angeles Police Department has opened a criminal investigation into the incident.

the school is in the wrong but most of the blame should be put on the rapist imo
 
The kid who raped him has probably been raped himself at home or by another family member. You just don't learn stuff like that.
 
This is disgusting.  I hope the family wins the case and can get their kid some therapy sessions.  People from the school need to get fired as well, these schools are quick to dismiss bullying complaints until something serious happens

.  The rapist should get tried as an adult and have his family tried too, I'm sure they have something to do with his behavior...

good lord is no one safe anymore? We from teachers raping students, to students raping each other. I swear if I didn't have a child now I wouldn't have one at all. Same **** happened in Harlem a few weeks ago where 3 7th or 8th graders made a 5th grade boy give them all fellatio :smh:.

So the school did nothing for months, and now the district comes out with a cornball statement of their own? This looks beyond bad for the school and the school district who did nothing. The parents did the right thing escalating it to this point

in this case the parents complained that during gym class he was being bullied. That, and the fact he is special needs should warrant more supervision for the child. The gym teacher was neglegent here. Think about the time it took for the boy to lure him behind the bleachers and do whatever he did to the boy. That is at least 15mins they were unaccounted for.

A big part of the blame has to fall to the gym teacher. A lot of time needed to lure someone behind the bleachers and perform the act without anyone noticing. Sounds shading. Gym teachers have an easy job too, one of mine in High school use to drink beer in his office while we played ball.

I'm still in awe at this. 8th grade boy, rapes 7th grade boy? I'm just..no words. and then was it real rape, like penetration, or sexual assault like molestation? I just..smh.
 
as a teacher I know that Gym is crazy... that's where a LOT of stuff goes down (although at my school it was just fights)

I will say this, I work at a public school. There would be 100 kids in a gym at once, and the state only mandated THREE adults to watch them. Now that's a public school. This is a charter, I'm wiling to bet they might have had JUST as many kids with fewer adult supervision. Even if it's half the kids, one person is supposed to watch 50 kids? Gyms are a huge problem because they stuff a bunch of kids in one place and a single adult is supposed to catch EVERYTHING , ALL the time?? This is extremely unfortunate but hopefully it'll be a wake up call to the numbers they give to PE teachers.

what's up with the same sex stuff though. i mean these actions are wrong with any age and sex, but still, how is it these young boys are doing these acts with boys and not girls? it's like instinctual (imo, until proven otherwise) that men are attracted to women, nature over nurture. So that also is wildly confusing to me.
