Ok so i have the HTC Hero little over a month now.. but i still have my old Touch Pro 1.. basically i used a uprgrade.

So my brother lost his phone couple weeks ago and i wanted to get him a new phone for Christmas ..

So my question is. if i change my phone back over to the TOuch Pro 1 can i use my warranty (tep) that same week to get a new phone then swithc it back to theHero??

Yes you can

When you do an ESN switch you have 30 days to add insurance to the phone

Well what i meant was i have the Hero with insurance right now/

can i switch my phone back to my old phone TP1 .. and use my insurance right away/

then switch my phone back to the Hero /

then give my brother the new warranty phone for christmas
