Unreleased Air Max 2009s?

Recently several color ways of the AM 2009 have been popping up at ROSS department stores. Mind you, ROSS sells legit items, just like Marshalls or TJ Maxx, just at a discounted price. These "new" color ways never released at major shoe stores, at least in the US, until recently at ROSS. The question stirring up is, are these unreleased samples? Or models released overseas and not in the US? There is one feature all of these do not have that the AM 2009's I own, and have encountered have. The Nike+ feature isn't on/in the shoes. Under the insole there is no indention for the nike+ chip, and on the bottom of the shoe the nike decal doesn't have the "+" beside the swoosh like on other models. Instead the insole has the "Fitsole 2" branding. All of this leads me to believe these pairs are legitimate but just weren't made with the Nike+ feature, and instead a more comfortable insole???? I've provided several listings across eBay of the shoes as well as pictures to assist with my questions. 

I searched the item number of a pair of the shoes (volt pair) and it came up with this website. It is well established that Ross may receive pairs of shoes that were never released: See examples below. Judging by the looks of your Air Maxes, they are most likely legit but Nike probably did not want to release them.
