If they are both intoxicated is poor judgement, if he/she was sober and the other one wasn't then I can understand how someone can get taken advantage. However, I think they should treat this like a DUI, if they get into an accident while drunk - you are the one to blame for being intoxicated.

the only legal implications the poster is making is,
the woman is the only one allowed to yell rape.
if this was giving a warning to general public, it shouldn't have make the scenario where the man is the aggressor and the woman is the victim.
I do understand the message that they are trying to convey, but is poorly done!
again, one of the reason why males get laughed at when they yell rape ... it will continue to be this way until awareness is spread just like everything that is just now being more culturally accepted like homosexuality.
