Selling "Used" stuff as "New"... Is it cool with you?

Is it Ok to post "Used" items as "New" if it's only been worn a couple times and "hasn't been washed"?

So... I was doing my regular rounds today, looking for new stuff online, and I came across this listing for a Bape Shark Hoodie: http://www.ebay.com/itm/Bape-Blue-Camo-Shark-Hoodie-/251851583830?ssPageName=ADME:X:RTQ:US:1123 . Of course, I was a little skeptical of the item because the pics weren't tagged and the seller was new, so I decided to send him a message to see if I could get tagged pics. Also, just because I've seen newbies list used stuff as new, I asked him if the item was in fact "New without Tags", as he listed.

He messaged me back with this:


"No its been worn, it CAN PASS AS DS. No flaws, never been washed." (his emphasis, not mine)

When I messaged him back and told him that it was messed up to list a used item as "New", he got upset, not understanding why I was "butthurt" and telling me he can't believe I was upset about that, as he's "never had no one wine about that". Bear in mind, the dude has ZERO feedback, so it makes sense nobody would "wine" about it.


He also said he was gonna post our conversation to NT, to which I told him to do it and to send me a link, so I could respond. As it seems like he isn't going to do it, I figured I would do it for him, because I'm honestly curious what you guys think about this.

Anyways, my question is this: am I wrong for getting utterly frustrated and annoyed at this guy for posting an admittedly "Used" item as "New", or is this now accepted in the "Buy/Sell" community? Is it ok to list something as "New" if it has "never been washed" and has "no flaws", or is that still a USED item? I tried to reason with this guy and ask him how he would feel if he bought something listed as "New", only to find it had been worn a couple times, but I guess that kind of thinking was above his train of thought. Anyways, let me know what you guys think. It is seriously a pet peeve of mine (on the level of cats listing "Unauthorized" kicks as "100% Authentic"), but maybe I'm tripping...
 
I honestly just couldn't believe how the dude replied to me, like I was insane for calling him out on that. I honestly should've just reported the listing, but I want him to sell the hoodie, because maybe then he'll understand why it's wrong, once the buyer files a claim and reports him. And you're right, it does happen all the time, sadly...

Yea, I never understand why people do this. Bought a pair of Kobes awhile back that were listed as "brand new, never used". I received them and immediately noticed they had been worn. I'm talking rocks in the traction. I contact the seller and he goes, "they were only worn for a couple of hours during a photo shoot...they're practically new." I didn't even bother responding, and went straight to PayPal to file a claim. Dude then had the nerve to contact and say that I should keep them since I got them for a good deal. :smh:

As an eBay seller, I always undersell my products and over deliver. I have spotless feedback and an impeccable track recorder. I will never understand idiots that do this. It's a complete waste of time that will never end well for them.
 
This is precisely the reason why I pay a 300$ mark up on the 2 sneakers I purchase every year.
 
the question should be asked who in their right mind is buying these goodies now days especially for $300

i just reported his listing to ebay as well for trying to circumvent paying final value fees.
