The person ahead of you usually has the right of way, so you should always proceed with cation weather if you drive a semi truck or riding a razor. 
 
How does a parked car have the right of way?

Btw, most states have laws that puts the driver at fault for accidents like this, so there's no "right of way" for a parked car:

"No person shall open a door on a motor vehicle unless it is reasonably safe to do so without interfering with the movement of other traffic, including bicyclists and pedestrians."

It's all good, just my opinion of people negligent of their surroundings.

yeah your right I read it wrong, i though he walked to his car and opened his door then the kid ran into the door while its open. But it seems like he got INTO his car and closed his door ,then opened it failing to look around to see if it clear for him to open it cause like a semi truck could of ripped his door right off. Hopefully the kid pulls through.

I usually always look before opening my car door. Its a habit.
It was at night and the kid had no lights on his bike flying down a decline. Yet thats my fault? Its not my fault nor the kids. But if you want to play the blame game, we can say its his parents fault? For you to turn this into a "people like you" argument just shows the type of person you are.

This afternoon I went driving around the neighborhood trying to find the suv his father was driving. The kids bike is still at the house and I wanted to see if he make sure he was ok but I couldnt find where they lived. Im sure eventually they'll come back for his bike or something.

I doubt a law suit would be brought against me. I wasn't negligent and it was unavoidable.

Yes I still live out my car, but sometimes I have a place to rest my head. My situation is complicated so I have to tough it out a bit longer.

But that's the root of the problem papi. Nobody KNOWS whether or not there's going to be a kid zooming by unless you check for it.

a woman tried to sue me, she couldn't see me actually she went after my insurance


i did not get ticketed in the accident...................she never got 1 penny from me or State Farm as i was clearly not at fault

she had hospital bills but she should be thankful she was alive after she spun me around 360 into a snow bank
 
Isn't there a law that bikes gotta have lights at night tho? I mean if he was on a suburban street where there is no street lights even checking the mirror he could've missed pleighboi. Hope Lil dude ok tho, u can always get your crib fixed.

Yeah but dude was just grabbing his watch really quick. He probably had an idea of his surroundings (subconsciously) before getting in his car, and the brain probably thought it would be an in and out event (go inside, grab watch really fast and leave) that he didnt really think of his surroundings and popped the door open.

Distractions happen and its being in the wrong place st the wrong time.

Looking doesn't always prevent an accident.

This isn't even the discussion to be had here honestly. Start a thread about road safety if you like but piling guilt on isn't helping anyone.

yes indeed and also to take account that it happen at night and not only the kid didnt have reflectors on his bike and parents were arguing, his mind wasn't also all there as he was trying to escape the things he didnt want to hear. So he stormed out, grabbed his bike and just pedal to the metal (op was probably in his car door close reaching for his watch) down this hill, op might of looked around or not, either way it was clear cause it was dark out, if there was a car there would of been head lights coming his way and street lights can only do so much. Op opened then, BAMB. And yes wrong place wrong time all he can do now is wish kid pulls through and hopefully op doesnt have to lawyer up, I'm sure hes had enough of the Bs. (was creepin on your last thread) 
 
Situations like this is almost always an accident. How does that make it any better whether it's an accident or done on purpose? It takes two seconds to look into your side mirror for this easily avoidable accident.
 
I find it especially obnoxious when they literally kick the door open.

Crazy. I wish the kid a speedy recovery. Good on you OP for helping as much as you could and keeping him calm.
 
Monday I drove down the street the kid said he lived on and saw an suv that look similar to what his father drove. So Tuesday night I decided to stop by that house to see if it was in fact the house. As soon as I got out my car another car pulled up behind me and his father comes out and asks if I was the guy from Saturday. I say yes and ask if his son was ok. He says yes and invites me inside where the kid and his was. The mother thanked me and told me what happened afterwards. He began losing alot of blood and went into shock. His carotid
artery was cut so the fixed that but he still kept bleeding and the couldn't figure out why. They went back in and figured out his jugular was cut as well. They got that under control and he was sent home on Monday. The surgeons said if i didnt act and as fast as I did he would of died. I remember when the medics came and took over, they weren't applying pressure but rather just bandaged him up and put him on the stretcher. I figured they knew what they knew what they were doing and thought not much of it. They did think about coming back to the house to see if I lived there cause the kid wanted to know who I was. I gave the kid a hug, told him he can come get his bike and bounced.

Glad he's ok. Thats all that matters
