LC Jordan 3 Black Cement

I found a pair of DS Jordan III Black Cements (2011) online. The seller wants my pair of Infrared 3s + $20 for them. He said they were bought through Flight Club, but he has no receipt. When asked why he would resell for far less than he paid, he said that he needed the money badly. I have lots of pics, and the left tongue stitching looks messed up. Apparently he called Flight Club about it and they told him it was a manufacturer defect. Legit or No? Does Nike factories mess up like that?
