Anyone ever won a harassment case at work? Vol. EOCC

i aint saying u lying
nothing of the sort
im just giving u a different perspective

That’s what I made this thread fam’, & I appreciate the feed back. I feel like I have more to gain than to lose. Bills are paid for the month, I’ll have a new job at the end of the week if need be. But, sometimes you have to humble some people.

Just go on a tangent about verbal abuse and how you felt threatened by his hostile language and how it caused an uncomfortable work environment and that he insinuated he could talk that way with no repercussions given his status with the company.

Yup, kind of hit the ol’ Employee handbook & looked at the EOCC.gov page. Looks like I’m on the right side of a win. Not looking for money, or perks. Just taking a real a-hole down a notch.

And verbiage is key when making any claims or dealing with HR. Also document any interactions or anything moving forward in the workplace. Especially anything that could be perceived as retaliation.

Convo was already heated fam, when he came out crazy we both puffed out our chest.
My co worker literally got between us to separate us. I didn’t get heated until he tried talking down on me:
If someone separated you then you didn’t want to throw down to begin with. This ain’t middle school

Appreciate the advice fam, I’ma try my best. Seems like I have a bit to lose, but much to gain. Trying to secretly record tomorrow’s convo with VP.

Bro, this is a work environment. Not a street fight, voices got loud, disrespect was lashed out. Not everything get solved with fists, sometimes you have to fight with words/HR. It’s a dirty fight, but one that must be fought.

Nothing like that fam, we were never nose to nose. I stood in the same spot, but I looked at him directly & spoke up when the disrespect flowed. Had my hands behind my back the whole time, held my IPad/work phone. Never was aggressive but my co worker knows me. Once I’m agitated I’m another person.
See this the thing
In workplace issues
YOU may not feel u were aggressive
But To him u could have seemed aggressive
It sucks but with hr stuff
It’s very tricky

I feel you fam, definitely appreciate the tips.
I’m not saying my ish’ don’t stink, maybe I was a bit in a wrong. But on the other end, I’m not part of upper management. If I agitated him into some regrettable comments, that’s not my issue. I controlled my words the whole time. Again, never got disrespectful with him. Even called him by his name when I addressed him.

Bruh that’s illegal
Don’t secretly record anything
Also u might have a bunch to lose
Another job ain’t a sure thing till u start it
Even then it still ain’t a sure thing
till u pass probation

You see bro, that’s why I asked NT! Lol
Was thinking about it, but I know the risk.
Oh well, I’m the “little guy” in this scenario. If I don’t stand up for myself who will? Upper management is scared to move against him, he’s just the safety guy. Dude doesn’t have that much damn power over my job. Maybe 10-15%, & my bosses get his messages to us.

Yes sir, trying to rehearse what I’ma say. Trying to fight the good fight, even if I lose I go out swinging.

I’m a be real 90% of work beef
Can be squashed with just a talk
U would be no less of a man
By going to dude first apologizing
for “puffing our ur chest”
The proceed to explain to dude
U felt disrespected
And was there any issue
That he he had with u
that u were unaware of
9/10 he gonna apologize too
And say no
Y’all gonna joke and laugh and be all good
And might even have a better relationship with each other because of it
(I know ur leaving but still)
Never hurts NOT to burn bridges in life

Definitely man, appreciate the insight on how you see things. Definitely will consider it. They could just make ol’ dude apologize tomorrow, & I’ll Apologize as well.
It could get him or me fired as well, risks all the way around. Everything is already in motion, meeting set up at 7:30 AM with VP.

Unless someone jeopardizing ur job
U don’t jeopardize theirs

He got a professional telling him how to handle this Rn telling him what to answer, prepping him on the questions for tomorrow

Good luck man, you’re allowed to snitch on the boss anyways. :lol **** them

Co workers stick together, who cares about the boss.

Depends on the circumstance. I got a manager fired at an old sales gig I did years ago. Was basically talking to me in a rude disrespectful manner, talking degrading and would use our check in meetings as a means of personally singling me out in front of my peers/coworkers. One day during one of the check in meetings I just told him that him singling me out was very unprofessional and was creating a stressful work atmosphere for me. He felt embarrassed and upset that I put him on blast in front of all my coworkers and other managers. I just let him pop off and get everything off his chest. Again I told him that I didn’t appreciate being talked to in a degrading manner and if he had any issues work related or performance wise that I’d appreciate to be treated with the same respect he’d expect from me. That pushed his buttons more.

I had about a month or so of issues with him that I documented. Had a few coworkers back and verify what happened in that check in. Went to HR. They did their thing and he was no longer employed by the company when it was all said and done. His dismissive and disrespectful attitude left me no other choice. The way he would talk to me was pretty much trying to bait me into responding in a threatening or physical manner so I’d look like the hothead.

I got mad stories on this subject from my previous job. 2 different scenario about the same person,. Majority black people work there and it was like a big high school.

1st story: Knew this manager, Stan, who was over the NOC (Network Operation Center). His Director at the time, Farouk, was a class one a-hole. Farouk would be dragging people, calling you out in front of your peers, bending the rules even in the company policy. He stayed at Stan’s neck in meeting - embarrassing him.

Back story - Stan’s family is in Canada. He was only in Atlanta to work and would fly back on the weekends to visit. However during the week, Stan wouldn’t go home at times and pull all nighters. Or, sleep in his office. The company have showers in the gym. So he would freshen up, then be right back in the mix. Plus the NOC is 24x7, policy wise it was justifiable. Now mind you the policy doesn’t speak against it.

Based on Stan’s job description, he’s only supposed to be asked to work within certain terms (special project but is not needed) and is not required to be on-site on the weekend because the NOC is 24x7 - and CAN be off-site as needed.

Farouk, found out Stan would be staying overnight in the office. And, called him out about it in a meeting of all his peers. “We can’t have anymore people making their office a campsite. You need to do your personal home stuff at home. Stan no more office sleep overs.”. Just being an ***-hole.

Well Stan’s wife was going through a major surgery due to cancer. He went to talk to Farouk about it and ask for extended time to work from home - Stan secretly recorded the convo on his iPhone.. I think he used his sick time but needed more time (not truly sure about this) Apparently Farouk gave him somewhat the okay to do Friday - Monday remote. However the other days, he needed to be there.

Welp there was a project, that came up and Farouk asked Stan to be on-site after Farouk told this guy they had somewhat understanding. Stan basically told Farouk in private that he wasn’t going to be there because of prior arrangements.

What Farouk does? Calls him out in front of his peers about him being insubordinate and once again sleeping in the office. Straight embarrassment and power trip.

Stan, goes to talk to the CIO privately about Farouk’s behavior and also the situation (without Farouk knowledge), But Stan, recorded this convo, too.. Of course, the CIO doesn’t side with Stan and stated that Farouk is your immediate supervisor and for special request of projects - you are needed to be on site. Well the CIO confronted Farouk about the meeting and some words got exchanged. Of course, Farouk got at Stan’s neck about it.

Not actually the results Stan wanted. So, Stan goes to EEO and file a complaint. Mind you, EEO only serves as a mediator and usually side with management based on policy. Stan started asking people to stand as a witness from Farouk’s behavior and etc,

When people started becoming hesitant about it, Stan started to go a different way about it. Asking for statements instead and this and that. Grade A ratting type stuff  I think only 2 people came forward about the behavior but those 2 people had file a complaint to EEO prior to Stan.

Long story short, Stan told those folks about the recording...Boom...they walked Stan out. Come to find out, Stan was secretly recording everybody convo without consent.

Stan threaten to sue them. Farouk still kept his job...

Now this goes into my next story.
