CA Labor Law Question

If you work full time hours (32+) for an extended period of time are you entitled to full time status by law? Somone at work had mentioned this and I will lookinto it tomorrow after I get off work but in the meantime I wanted to know if anybody knew anything about it.
 
i work at Sams Club in Texas and they try to do us dirty like that...work 32 plus hours(considered fulltime hours) but only label us as part time.. so theydont have to pay us extra or holiday vacations..im only 20 and go to college so i work around 25-30 a week but when summer comes around or schools out impushing like 37 plus hours a week but they dont give me the extra time off or preminums.
Sams has this thing called Sams Share, where every store earns a bonus at the end of the year up to 600 for part time and 1200 for fulltime for like noaccidents, control on merchandise and stuff like that..but when that time comes they move everyone down to part time so all the mangers get the rest of themoney..they work you 31 hours and make sure u dont hit 32 so u wont be considered full time....
 
technically yeah. they do this to me all the time. only problem with me is im not consistent with my hours. one week i'll do 20 the other 40 so I have nogrounds on making an argument. If I were you though I'd definitely do/say something bout it.
 
From what I understand (do your own research as everything below may not be 100% accurate):

what a lot of employers will try to do is.. they call their employees "part time" just because they work less than 40 hours a week and try not togive overtime. However, overtime is calculated daily and weekly.

So if you work 10 hours a day for 3 days and only end up working 30 hours in a week, you are still entitled to overtime pay of 2 hours for each day.

Now if you are trying to get "full time" status so you can receive benefits, then you have to know that it is not mandatory employers give benefits(of course unless its company policy to do so).

I've worked 32+ hours ever since I can remember, and I used to work a full 40 but they never made me part time. Now they want to cut part timers to 10hours a week

. I need to find out if they have to make me fulltime because of all the hours I've worked in the past so I can at leas get 32 hours which is the minimum for FT..
