Later that year, Tesla published a video, also cited in the lawsuit, which the automaker said showed one of its cars driving itself. The video was misleading, the lawsuit said, because according to Tesla employees involved in the video, numerous attempts had to be made before the car could be shown to maneuver through the route without obvious problems.

The last part makes sense IF the subsequent tests they ran after the first successful one also passed. However, the article isn't clear on that.

The accusation of fraud has to do with Tesla selling a mislabeled and misleading driving system. He could have called it very advanced cruise control and gotten away with it.
 
The defense the one guy had when Cuban was DMing him about the security risk of tracking his flights:

The person tweeting it is not releasing it first, but I get how a Twitter profile has an audience bigger than an FAA reading posted on a .gov, so even if it’s publicly-available before the Tweet posts it, the FAA data doesn’t have the same audience as a group that follows an account on Twitter. It’s a weird dynamic.
