Got a PayPal question...

I'm gettin ready to make a transaction to purchase some shoes without an Ebay transaction...

The person wants me to send the payment as a "gift" to avoid the fees, which is pretty customary...BUT, if for some reason I don't receive themerchandise, am I still able to open a dispute? Just want to make sure I've got all my bases covered...
