ipod video question

i just bought a 80 gig pod video 5.5 gen its like 3yrs old its brand new never been out of the package got a pretty good deal on it, i know all ipods come witha 1 year warranty but does the 1 year warranty go from when it was created or when u open it up and sync it, since its 3 years old im wondering if i shouldjust return it or sell it becasue its risky with out a warranty
