Because it's another case of the police doing way too much. Do you really think they are setting up checkpoints to check your license and insurance status? Even then they need probable cause to believe you don't have a license.

The way I see it it's just a fund raiser for our broke *** country. Throwing people in jail = $ one weekend in county is gonna run you about 500 bucks.

I'd like some clarification on this subject matter. The cop states that driving is a privilege, not a right, which I've heard before and most definitely agree with. So if you're driving into a checkpoint, with other cars as well, what "rights" are the cops violating by asking for your credentials, making sure you and the other people on the road are fully licensed, insured, and not in a stolen vehicle?

4th and 5th amendment. "We just wanna see if anyone is breaking the law isn't a reason to detain people." If he's not free to leave then he's being detained. There's a reason the cop wouldn't answer...


It's tricky though. They've changed the laws around a lot of this to make exceptions so it definitely violates the constitution. It depends on where you live and the situation but technically don't have to provide ID or any paperwork etc or talk at all. Most people just do it because we were taught to listen to what cops say and just like a lot of cops don't know the law or our rights.
