Little help NT Lawyers or Detectives:

My cousin and her husband own a moving company in a suburb of Chicago. They have been in business for 5+ years and have yet to have a negative review on-line.

They are small two person operation. She handles the calls and he runs the trucks and the moving. At no time do they ever tell customers they are the owners unless someone asks to speak to them. It is then that it s usually my cousin, the wife who represents the business.

A few weeks ago a friend of theirs from their neighborhood was dumped by his GF. That night he went to a bar and met up with someone. The woman became extremely angry upon hearing this and began claiming that the man had cheated on her. Either way it really was none of my cousins business. The woman then proceeds to call all of this mans friends (my cousin included) trying to spy on her ex bf. My cousin wanted no part of it so she just began ignoring her requests. The woman then begins leaving comments on facebook like "I'm going to make this hard on all of you very soon."

About a week ago one of the neighbors had received a phone call from a woman claiming that she was having an affair with her husband.

I find this all childish especially when you think that this woman is 40 years old and works at an established accounting firm. You would think she knows better.

Usually September is a good time for business and their phone had not rung in two weeks. My cousin then checks all her on-line pages and finds a long scathing review on Google. A couple red flags in the comment arise:
  • The review mentions my cousin-in-law, the male, as the owner. (They never disclose that he is an owner for a few reasons. That way if there is a problem, he can continue a move and they can deal with my cousin on the phone. Sometimes people can get heated if they are face to face. This also means he can work smoothly while my cousin can handle any concerns over the phone)
  • The comment mentions the face that my cousin does nails on the side. My cousin used to do this ladies nails until everything went south. My cousin has a beauticians license.
  • The review accuses the movers of doing things that even novice moving companies would not do.
  • The review name does not match any customers from the past year, even though I doubt this is something that can be proven or hold much weight with an internet review.
She suspended the Google page and is trying to get in touch with them so that she can get an IP address. They don't mind a negative review, but one that is false and a few paragraphs wrong can really damage their brand and image. This is the only source of income for them so two weeks of non-work is pretty big.

I encouraged her to get her statements together from the past few years so she can give a lawyer an average amount of business that was lost. I told her that a lawyer could probably be able to obtain the IP address just to see if it came from her phone, work or home computer. Not sure if this is possible.

Has anyone else been in a similar situation? I feel bad for my cousin because they are really honest and hard working people. They charge the lowest amount per move amongst all their competitors so I doubt the slow down is due to them not being price competitive.

i don't think you can really prove it was her that way.

Maybe if you had someone confront her and secretly record the conversation and she admits it then they should be able to prove slander and cash up.

The hope would be just to see if there was a way to pressure her into taking down the comment. Apparently this lady has a history of personal problems. They were hoping a lawyer could create some kind of pressure, the last thing they want is to waste time in court and then get damages that will probably be less than what the lawyers cost.

Get a lawyer to send a letter threatening legal action/civil suit if the comments are not removed.
