NT what's good with some legal advice?

All right so I was going to the mall yesterday it was snowing and right when i turned into the mall entrance which is basically a downward spiral my car slid and hit the guard rail, so I check it out a lil bumper damage get back in my car and wait while a few cars pass by, wait a few seconds and as I'm about to get going some dude rear ends me and throws me back in the guard rail. As soon as he hit me I look through the side view and see a suv with some white dude on his phone. So I'm like what the *%%% you doing on your phone and did you not %@#!$** see me and blah blah. So he comes out ask if we all right and starts talking to me to get me to calm down saying everything will be good and he has good insurance blah blah says maybe this will put you a little more at ease and hands me his card then tells me he's a lawyer. Basically what I want to know is, is there anyway I can be at fault?

He's at fault and to add insult to injury..............he was on a cell phone!That's a big no no when driving anyway (unless the user has a hands free device).
