I was reading about this yesterday and apparently the main crime is just having documents that belong to the US. It doesn’t matter whether they were classified or not, they aren’t his and he didn’t return them when asked.

I can’t see how they can’t prosecute him - but we may have to wait until 2024 so that they avoid any accusation of doing it for political reasons.
