Xbox 360 (& Xbox Live) Question

So I have a modded Xbox 360 and have had it modded for over a year now. However, I have yet to play a modded game on and don't plan to due to the risk of getting banned. I was wondering though if there's a possibility of getting banned still (if I continue to play legit games, of course). I update regularly and survived through the ban-waves during CoD:MW2 & L4D2. Does anyone have an article or something from a credible source/site that may mention that it's okay to do this?

They will still get you. Happened to my friend. He had a modded system, but never played modded games. Went online about 2 days before MW2 dropped, and got the axe

I avoided playing during that ban-wave (it was Finals week anyway) and my system is still good. My friend who modded my system did a lot of research and pretty much says its undetectable. But the bad part is its unflashable. I'm selling my console because I just bought an Elite (its an Arcade) and my friend who is interested wants assurance he won't get banned.
 
They will still get you... thats why i got two sittin right next to each other... btw Cleveland just got that W
