uh...exactly becuase her gender is women, the parts are irrelvelent.
there are people born with ambiguous genitalia, basically in between. they use the bathroom corresponding to gender.

This will probably hit the supreme court at some point, it will be a liberal majority and at some point LGBT will be a protected class and people will just have to get over it.
