have any of you guy's ever tried to sue for discrimination ?

Hey guys. I was recently going for a promotion at my job and I feel that I was passed over due to my race. I had a phone interview with my would be manager. I'd never met her before that point. The next day I notice her in my store and recognize her due to her name badge (I do loss prevention). She then attempts to walk by me and my coworker and as she does I attempt to introduce myself as the person she interviewed the day before and as I'm telling her this she cuts me off and says she doesn't know what I'm talking about or who I am. As she walks away she keeps me and my coworker in her sites as she then pulls out her cell phone and makes a call. Shortly after I then receive a call from the loss prevention manager from another store saying,
Cristina (the woman that interviewed me) saying that their are two big black guy's in the shoe department looking like they are going to steal. I then explain that she's referring to me and my partner. I then approach her again and explain to her that I am the loss prevention for the store and that I only wanted to introduce myself. She then goes on to say " oh I'm sorry. Is this how you guys catch people? Going around looking like you're going to steal? ". Regardless to say, I didn't get the job. It was given to someone with a lot less experience and of Caucasian descent. Is there anything that I can do? Is it worth pursuing? Im already looking for another job

How confident are you that the job was yours? Unless they gave you something in writing stating that, I don't see how you can prove it. You can still try, but that would take the help of the loss prevention manager that called you. Doubt that person would risk their job for something like this.

In all seriousness though sorry to hear that OP. Not sure how to handle this. I would like to think that I would have made a scene calling her out and quit on the spot, but I probably would have stood there in shock thinking did this really just happen.  Do you know who her manager is? Talk to someone above her about it.

Nah. Walmart. It was actually supposed to be a panel interview with three people. I found it odd that it was just me and her on the phone asking me generic questions. Shortly afterwards I found out from the manager of the other store that she only interviewed me as a token because she has to interview at least 3 people but she already knew who she was giving the job to
 
All I can do is smh at the situation. No apology at least from her? Is there an HR department you can speak to about this?

And what is the purpose of being plain clothes? At least have a jacket with the word "Security" on the back

will that other manager who said that be willing to put it in writing? you might have something if he/she will do that
 
You got a witness, go to HR about it first.

You never know, you may not be the first to report such activity.

She did apologize but when she did that's when she said "so is this what you guys do? Come to work looking like your going to steal?". How do I look like I'm going to steal if I'm plain clothes?? How does shorts and a t shirt make me look like s theif?
 
Try going the HR ROUTE, seeing that is Walmart best of lucks OP. Seeing how she spoke to you and the comments she made shows how much professionalism she lacks. If I were you I would try looking for an LP job for a different retailer such as Saks, Bloomingdale

There's no thief attire. She stereotyped you plain and simple
 
sounds like it could be discrimination


but the way you tell the story is kind of confusing - maybe you should take an honest look at your communication skills

Can you get the other manager to back you up that you were only interviewed as the token?
