Instagram’s New Terms of Use Agreement Is Already Being Called Its ‘Suicide Note’
Instagram cutting ties was just one major step towards it’s downfall, released its latest “Terms of Use” today, to the consternation of many of its more than seven million daily users. Most of the rules, which officially take effect January 16, include rational things like “no porn” and “you must be 13 to use Instagram.” But a couple are rightfully pissing people off:
Some or all of the Service may be supported by advertising revenue. To help us deliver interesting paid or sponsored content or promotions, you agree that a business or other entity may pay us to display your username, likeness, photos (along with any associated metadata), and/or actions you take, in connection with paid or sponsored content or promotions, without any compensation to you. If you are under the age of eighteen (18), or under any other applicable age of majority, you represent that at least one of your parents or legal guardians has also agreed to this provision (and the use of your name, likeness, username, and/or photos (along with any associated metadata) on your behalf.
and
You acknowledge that we may not always identify paid services, sponsored content, or commercial communications as such.
Instagram makes sure to clarify that it doesn’t “own” your images, but that’s of little import when they immediately follow up that assurance by saying they’ll still be allowed to hustle your pictures for commercial purposes with impunity. What’s worse, there is no way to opt out of these Instagram requirements. You can choose to either use the service and cede control of your images—which probably include a lot of pictures of you, your friends, and your loved ones—or not use the service.

Clayton Cubbit, a New York-based photographer popular on Instagram, dubbed the new terms of use “Instagram’s suicide note,” a sentiment with which hundreds of people have agreed thus far. But it’s worth noting that this kind of crazy commercialization of social media isn’t so crazy anymore.
“These kinds of terms are pretty common these days, which is unfortunate, because some of them border on the ridiculous,” says Woodrow Hartzog, an assistant professor at Samford University law school who writes frequently about law and the internet. Hartzog says that Instagram needs some level of copyright control user images because “many copies of user content are created via ordinary operation of the website.” But he adds, “I think it is fair to question the scope of many of these terms as potentially outside of the realm of what is required to operate. It’s no secret that users rarely read and understand these terms, so companies have little incentive to draft user-friendly agreements.”
In other words, until people start actually paying attention and demanding that tech companies stop overreaching when it comes to abusing user content, it’s unlikely anything will change.Source

at the end of the day it doesn't matter. no one ever spends the time to read a terms of service on any site they register.

I don't think people will care that much. Most of the photos are just spur of the moment snapshots that no one will think twice about. Of course there will be that contingent that tries to boycott, but whose attempts will fall on deaf ears.

At least they are being transparent with their new terms and conditions.

Yeah. most of the crap people post on instagram are meaningless anyway. I don't post party pics like I used to on fb.

It must be zuckerberg's goal to make things un-fun.

facebook buying em out i know was a bad idea...its not like da founders were gonna say no though, i would've sold out too

"abusing",, you are using their platform in turn they are going to use your content. It is what it is.

The only people that will be bent are the people that use these platforms as free advertising to push their product/services. They are the ones that always get bent out of shape.

I don't take what I post too serious, frankly only post things that are "safe"...

I still say them taking out twitter embedding is their nail in the coffin. I do not feel like clicking on every instagram link now, instead of merely displaying the photo in someone's tweet. Or the profile views. Instagram is headed down facebook's path of irrelevance, and another site will pop up in its place. Quote me on that one. Nothing lasts long in this industry.

Put in a policy to not allow Tweetgrams. That is what Twitter is for.

This sucks though. This has been probably the only social media platform that actually got me addicted.

I get the concept but its not like we were gonna make money off of IG anyway.

A lot of thirstiness would arise if IG paid certain users for _____.

If IG makes guap off a dumb pic I'm sure ppl will get angry then. If they're allowed to use your likeness who knows what they'll do and how they'll make money off it when you get nothing.

There's always gonna be other sites. So yeah I agree this could be the first few nails in their coffin. No porn :smh:

Ive been reading that some accounts getting deleted with having racy pics.

Doesnt explain a ton of accounts with extremely racy pics, maybe they havent gotten to em yet.

Whats with all the highlighting and stuff?

Its always been a "rule" on IG that you coudnt post certain types of pictures.

Never understood the point of people putting their whole life out there on these joints. They probably deserve to get used

The whole social network landscape is now seeming like a trap.

Hey come use our platform its cool. Ok i like it i will. Then after you get enough people on it and have enough "information" to sell to marketers you say "oh btw new terms of use, we own or will be using all of the information you posted on here" HAHA Gotcha Bishes

I am not on facebook i use twitter sparingly to just see whats up in the world and i actually like Instagram even though i rarely post pictures. But the influx of emails i get from advertisers already im sure will get worse once they lend all my information out now. I am probably going to now delete my instagram account or at least all of my pictures and just use it to browse.
