DAs are also attorneys that don't like to lose, so I don't know why they would throw this at you if you could so easily defeat it. Listen, I fully understand if you don't believe me. Most people think I'm lying. From what I understand, the cops viewed the videotape at school but didn't take a copy. I was arrested Wednesday at 12:00 pm and I remember at the precinct the cop was asking how you reference a videotape that they don't have possession of. After that, I was sent to central bookings downtown and I got out yesterday morning at 11:00. I don't believe the DA saw the videotape prior to the arraignment, they just read the statement of the guy accusing me. I didn't waive my rights so I didn't speak to the police at all so they have no statement from me.

The only reason I could see you not wanting to share the entire story is because you don't want to incriminate yourself. That being said, good luck. Baruch, being a public school, probably will not be able to expel you or suspend you indefinitely if you are found not guilty. However, being found not guilty doesn't mean you're innocent. It means that there wasn't enough evidence to convict. Usually, the fact that the DA is going this far would mean that in a general sense, there was enough probably cause to take the case to trial.
I hope everything works out. If Baruch tries to pull something after you are (hopefully) found not guilty, then I would file a suit against them. However, regardless, I would still look into transferring like 206 said, just because of the stigma that something like this carries. Things will never be the same there again. That would also hold some weight in a court of law if and when you are able to file a suit against Baruch.
