I totally get this too... however when any table comes in I'm their favorite... including groups of straight dudes from Columbia.  I'm fun, good at my job, etc.  Also we all have uniforms, jeans and a T shirt that they gave us- so none of us can even show cleavage. 


What did the lawyers tell you? Unfortunately for you, I think it's really hard to prove your case. I would try to have other polls there when you talk to your manager about it so they can be a witness.

in the food service industry the owner can promote whoever he chooses

just because you say you want to be a bartender doesn't mean that you boss has to promote you regardless of your job performance

The difference is her boss told her that he didn't want her behind the bar because of her appearance that "shows" her sexual orientation.

This is true but there usually has to be some performance basis by which promotion (or lack thereof) is considered. Factors such as race, religion, and sexual orientation are usually not legal factors by which one can make this decision. As people have stated, a lawyer in your area, especially one who specializes in workplace discrimination can better help you determine what your best course of action is. I understand the owner wanting a certain image, but be tactful about it. The manager straight up saying he doesn't want lesbians behind the bar shows that hes not too bright whatever way you wanna slice it
 
Unfortunately for you in this type of industry the boss can discriminate if he deems that he is going to loose clientele.
I'm sure a strip club owner can discriminate against fat woman and it is acceptable.

In this case how does he know you are a lesbian? If he spotted you then you have a problem and if he/she was able to tell in his mind his clientele will be able to tell to.

Maybe you are better than you think at your job and he wants you there.

Regardless of the fact, if you want a bartender job go find one - you got hire as a server and if he wants to keep you there you have no grounds to argue. He doesnt have to promote you to anything if he doesnt want to.

Not always the most qualify get promoted!
 
I doubt you'll be able to do much legally unless you have a recorded conversation or some eyewitness testimony.

Best bet is probably to find another gig.

I'm not really a fan of the whole "cute girl who doesn't know how to make a Manhattan" thing either. Yes, I enjoy looking at pretty women but I'd rather my bartender know how to make a good drink.
 
If your manager said that he wouldnt make you a bartender because you are openly gay.. well then that's obviously prejudice in the workplace. However, it would be pretty hard to prove this to a lawyer. So I'm not really sure there is much you can do about it unfortunately.

In reality I think you may be overlooking the situation a bit. It's a bar near a school.. of course they are going to hire Sorority and Fraternity people to work the bar (experienced or not). That's college. They are the people who will consistently bring business to the bar. I haven't ever been to a college bar that actually cares if you are a "good" bartender or not, it's who can you bring in to bar and because that's how they make money. If you are truly upset about the situation leave, but I guarantee there is someone out there who cant find a job right now and would put up with the nonsense just to be making the money that you are.
 
Your boss is doing what he thinks is best for business but honestly, you're not a hooters girl. You're trying to be a freaking bartender. I don't see what his problem is... Oh that's right, you have posted that picture yet. TWO DAMN PAGES OF TIPS AND HELP! Where are the photographs of thou's self that were offered?
