Some false info being spread in here. There's really only two ways AT&T will only allow you to have any smartphone without a data plan. One is if you have been using the smartphone since before October/November '09. They allowed smart phones without data plans before then so some people were grandfathered in. Option two is to put your sim into a "dumb" phone and call AT&T to have data completely blocked. That means no picture messaging, no visual voicemail, and no data of any kind is accessible through the phone. Once that is done, you can put the sim card into a smart phone and might be able to use it without a data plan. Option two doesn't work for everyone for whatever reason though.
