Paypal claim after 45 days??

Can I still file a claim on paypal after 45 days?? I did a pre order for the cement 4's. I paid  in Dec shoe were suppose to be shipped out in late Jan. As of today I still havent got them. I tried emailing dude 3 times and havent hear back from him. So now I'm thinking this dude got me. My only hope is that he ships out on release date. Is there anyway of filing a claim to get my money back. I have bought 3 other pairs before and got them but for some reason I have a bad feeling this time around.

U got the other pairs from the same seller? Generally paypal is strict with those deadlines.
